A BILL FOR AN ACT

 

 

relating to boards and commissions.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 26, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§26-    Boards and commissions; absence of chairperson; assumption of authority and duties; priority.  (a)  In the absence of the chairperson and all co-chairpersons at a hearing or meeting of a board or commission, the authority and duties of the chairperson shall be assumed by a member of the board or commission in the following order of priority:

     (1)  Deputy to the chairperson;

     (2)  Vice chairperson; and

     (3)  The most tenured member.

     (b)  No staff member of a board or commission shall assume the duties of the chairperson of the board or commission in the chairperson's absence.

     (c)  For the purposes of this section, "most tenured member" means the member who has the longest period of current continuous service on the board or commission."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
