A BILL FOR AN ACT

 

 

relating to feral animals.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that feral animals are a persistent nuisance in urban and suburban communities throughout the State.  Feral animals create nuisances by foraging in residential areas, entering into yards and gardens, and digging up plants, posing health concerns with their waste.  Unsanitary droppings and parasites from feral animals are a health and safety concern for students at department of education schools.  Establishing a prohibition on the feeding of feral animals will create a safer community around department of education school campuses and protect Hawaii's keiki from infectious diseases.

     Accordingly, the purpose of this Act is to prohibit the feeding of feral animals within a certain distance from department of education public school campuses.

     SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part VI, subpart A, to be appropriately designated and to read as follows:

     "§302A-    Feeding of feral animals; public school campuses; prohibited.  (a)  No person shall knowingly feed or attempt to feed any feral animal within       feet of a public school campus.

     (b)  A person who violates this section shall pay a $           civil fine for each feral animal the person fed or attempted to feed.

     (c)  For the purposes of this section, "feral animal" means an animal that has escaped or been released from domestication and is living in a wild and unconfined state."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
