A BILL FOR AN ACT

 

 

relating to CABLE TELEVISION SYSTEMS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 440G-8.3, Hawaii Revised Statutes, is amended by amending subsection (f) to read as follows:

     "(f)  The director shall ensure that the terms and conditions required of the operation of an access organization designated under subsection (a) are fair to the public, taking into account [the]:

     (1)  The geographic, topographic, and economic characteristics of the service area and the economics of providing cable access in the service area[.]; and

     (2)  The economics of providing access in the service area, including but not limited to enabling connectivity and educational training in digital literacy, media literacy, and workforce development."

     SECTION 2.  Section 440G-14, Hawaii Revised Statutes, is amended to read as follows:

     "§440G-14  Reports.  Each cable operator shall file with the director reports of its financial, technical, and operational condition, including viewership numbers, and its ownership.  The reports shall be made in a form and on the time schedule prescribed by the director and shall be kept on file open to the public."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.

Report Title:

Cable Television Systems; Public, Educational, or Governmental Access Channels; Considerations; Report; Viewership Numbers

 

Description:

Adds additional considerations for the Director of Commerce and Consumer Affairs to take into account when ensuring that the terms and conditions required for operation of an access organization are fair to the public in its designated service area.  Requires cable operators to include viewership numbers in its reports to the Director of Commerce and Consumer Affairs.
