A BILL FOR AN ACT

 

 

relating to a modern hawaii history museum.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the Bernice Pauahi Bishop Museum generally covers pre-contact and early Hawaiian history and that Iolani Palace covers the Hawaiian monarchy and overthrow era.  However, the State has much to celebrate and share since then.  The legislature further finds that the State has made national and global impact that is not preserved and exhibited, including the history of its World War II generation of leaders, statehood, and groundbreaking political wins that have led the nation and influenced the rest of the country.  Notably, Hawaii has led the nation through policies, such as:

     (1)  The passage of Title IX of the Education Amendments of 1972, which prohibits sex discrimination in any education program or activity receiving federal financial assistance;

     (2)  The enactment of Act 1, Session Laws of Hawaii 1970, which decriminalized abortion;

     (3)  The passage of Act 210, Session Laws of Hawaii 1974, which set minimum health benefit standards for employers;

     (4)  The Hawaii state supreme court decision of Baehr v. Miike, 80 Haw. 341 (1993), relating to the right of same-sex marriage; and

     (5)  The enactment of Act 97, Session Laws of Hawaii 2015, which established a renewable energy portfolio standards' target of one hundred per cent renewable electric energy by December 31, 2045. 

     Accordingly, the purpose of this Act is to:

     (1)  Establish a museum of modern Hawaii history;

     (2)  Establish a task force to prepare the plans, specifications, and designs for the construction of the museum of modern Hawaii history; and

     (3)  Appropriate funds for the purposes of this Act.

     SECTION 2.  Chapter 9, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part   

MUSEUM OF MODERN HAWAII HISTORY

     §9-A  Museum of modern Hawaii history; established.  (a)  There is established within the foundation the museum of modern Hawaii history.  The operations of the museum of modern Hawaii history shall be funded and supported by the modern Hawaii history special fund established pursuant to section 9-B.

     (b)  The museum of modern Hawaii history shall:

     (1)  Focus on the territorial and statehood eras of the State's history; and

     (2)  Chronicle the State's significant milestones and events in its recent history as well as the leadership that the State has demonstrated with respect to many significant issues facing the nation and the world.

     (c)  The foundation may establish a nonprofit group or select a nonprofit group with the demonstrated qualifications to manage and operate the museum of modern Hawaii history, its concessions, or other for-profit business enterprises in a manner that is self-sustaining.

     §9-B  Modern Hawaii history special fund.  (a)  There is established in the state treasury the modern Hawaii history special fund, into which shall be deposited:

     (1)  All revenues from the operations of the museum of modern Hawaii history, including any concession fees;

     (2)  Appropriations made by the legislature to the fund; and

     (3)  Any gifts, donations, and grants from public agencies and private persons.

All interest earned or accrued on moneys deposited in the fund shall become part of the fund.  The fund shall be administered by the foundation; provided that the foundation may contract with a public or private agency to provide the day-to-day management of the fund.

     (b)  Moneys in the modern Hawaii history special fund shall be used for the planning, design, construction, administration, and operational costs of the museum of modern Hawaii history."

     SECTION 3.  (a)  There is established a museum of modern Hawaii history task force within the foundation on culture and the arts for administrative purposes to prepare the plans, specifications, and designs for the construction of the museum of modern Hawaii history.

     (b)  The working group shall consist of the following members:

     (1)  The executive director of the foundation on culture and the arts or their designee, who shall serve as the chair;

     (2)  The president and chief executive officer of the Hawaii tourism authority or their designee;

     (3)  The state archivist or their designee;

     (4)  A representative of the University of Hawaii board of regents; and

     (5)  The chairs of the standing committees of the senate and house of representatives with subject matter jurisdiction over culture and the arts or their designees.

Members of the task force may recommend additional members with appropriate special expertise to the task force, for approval by the chair.

     (c)  The task force may invite developers to prepare plans, specifications, and designs for the construction of the museum, and review for approval the proposed museum development plans submitted by developers.  The task force shall supervise all development of the museum pursuant to the development plan approved by the task force.

     (d)  The working group shall submit an annual report of its progress, findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of each regular session.

     (e)  The members of the task force shall serve without compensation shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.

     (f)  No member of the working group shall be subject to chapter 84, Hawaii Revised Statutes, solely because of the member's participation in the task force.

     (g)  The task force shall be dissolved on January 28, 2027.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $250,000 or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 into the modern Hawaii history special fund established pursuant to section 9-B, Hawaii Revised Statutes.

     SECTION 5.  There is appropriated out of the modern Hawaii history special fund the sum of $250,000 or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for the planning and design of the museum of modern Hawaii history.

     The sums appropriated shall be expended by the foundation on culture of the arts for the purposes of this Act.

     SECTION 6.  In codifying the new sections added by section 2 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 7.  This Act shall take effect on July 1, 2023.
