A BILL FOR AN ACT

 

 

Relating to Asbestos.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The department of health shall conduct a study on possible means by which the State can reduce the number of single-family dwellings that contain asbestos.

     (b)  The study shall analyze and evaluate the following:

     (1)  Total number of single-family dwellings existing in the State that were built using asbestos-containing material;

     (2)  Effects of requiring these single-family dwellings to be demolished or renovated using materials that do not contain asbestos, including:

          (A)  Effects on the health of residents in the dwellings, residents who reside in the vicinity of the dwelling, and the renovation or demolition crew during renovation or demolition; and

          (B)  Cost of renovating or demolishing the dwellings in compliance with construction standards and notice requirements applied to commercial buildings; and

     (3)  Any other means by which the State may reduce the number of single-family dwellings that contain asbestos.

     (c)  For the purposes of the study, the department of health may consult with other state departments, agencies, or professional organizations.

     (d)  The department of health shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2025.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for the department of health to conduct a study required in this Act.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2023.
