A BILL FOR AN ACT

 

 

Proposing an amendment to article 1, section 23, of the hawaii constitution relating to marriage.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


    SECTION 1.  The purpose of this Act is to repeal article 1, section 23, of the Constitution of the State of Hawaii to remove the legislature's authority to reserve marriage to opposite-sex couples.

    SECTION 2.  Article 1, section 23, of the Constitution of the State of Hawaii is repealed.

     ["MARRIAGE

 

     Section 23.  The legislature shall have the power to reserve marriage to opposite-sex couples."]

     SECTION 3.  The question to be printed on the ballot shall be as follows:

     "Shall the state constitution be amended to remove the legislature's authority to reserve marriage to opposite-sex couples?"

     SECTION 4.  Constitutional material to be repealed is bracketed and stricken.

     SECTION 5.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
