A BILL FOR AN ACT
RELATING TO AGRICULTURE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. (a) The department of agriculture, in consultation with the department of commerce and consumer affairs, department of health, department of taxation, and other state agencies as necessary, shall conduct a feasibility study on the impact of roadside stands displaying and selling value-added products and the establishment of additional requirements for retail agricultural-based commercial operations.
(b) In its study, the department of agriculture shall consider the following:
(1) The economic impact of roadside stands displaying and selling value-added products in the State;
(2) The impact to retail activities in
agricultural districts if a minimum percentage of agricultural products that must be produced on the property in
order to be offered for sale at retail agricultural-based commercial operations
were to be implemented;
(3) The
impact, if any, to the counties for considerations under paragraphs (1) and (2);
and
(4) Other
issues that the department considers noteworthy and significant related to the
authorized activities and uses in agricultural districts.
(c) The department of agriculture shall submit a
report of its findings and recommendations, including any proposed legislation,
to the legislature no later than twenty days prior to the convening of the
regular session of 2025.
SECTION 2. This Act shall take effect on July 1, 3000.
