A BILL FOR AN ACT

 

 

RELATING TO BURIAL SITES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that it is necessary to clarify the definition of "burial site" in section 6E-2, Hawaii Revised Statutes, as its current definition results in questionable interpretations involving multiple burials, secondary burials, marked burials, associated burial goods, and the immediate surrounding archaeological context of burials.

     Therefore, the purpose of this Act is to clarify the definition of "burial site" to address the problematic aspect of the current definition.

     SECTION 2.  Section 6E-2, Hawaii Revised Statutes, is amended by amending the definition of "burial site" to read as follows:

     ""Burial site" means any specific marked or unmarked location where prehistoric or historic human skeletal remains [and their associated burial goods] of an individual or set of individuals are [interred,] found, and [its immediate] the surrounding [archaeological] cultural context, including associated burial goods that may be present, deemed a unique class of historic property and not otherwise included in section 6E-41."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
