A BILL FOR AN ACT

 

 

relating to workforce development.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that probation is the criminal sentence most commonly imposed for juvenile offenders.  Probation allows a young person to avoid incarceration while receiving needed rehabilitative services, mental health assistance, or treatment for a substance abuse disorder.  The legislature believes that a young person who is serving a term of probation should be encouraged to avoid recidivism by building a meaningful career.  A young person should not be made ineligible for a workforce development program solely because the person is on probation.

     Accordingly, the purpose of this Act is to prohibit private and state workforce development programs from rejecting an applicant who is eighteen years of age or younger based solely on the applicant's active term of probation; provided that the person is in full compliance with any court-ordered requirements or conditions.

     SECTION 2.  Chapter 352D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§352D-      Workforce development program eligibility; youth on probation.  No private or state workforce development program shall reject an applicant who is eighteen years of age or younger based solely on the applicant's active sentence of probation; provided that the applicant is in full compliance with any court-ordered requirements or conditions."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
