A BILL FOR AN ACT

 

 

RELATING TO ARTIFICIAL INTELLIGENCE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established an artificial intelligence working group in the office of enterprise technology services to develop acceptable use policies and guidelines for the regulation, development, deployment, and use of artificial technologies in the State.

     (b)  The working group shall consist of the following members or their designees:

     (1)  The chief information officer of the office of enterprise technology services, who shall serve as chair of the working group;

     (2)  The chief data officer of the office of enterprise technology services;

     (3)  The director of commerce and consumer affairs;

     (4)  The director of the office of planning and sustainable development;

     (5)  The chief energy officer of the Hawaii state energy office;

     (6)  The president of the university of Hawaii;

     (7)  Three members from the public or private sector, to be appointed by the president of the senate; and

     (8)  Three members from the public or private sector, to be appointed by the speaker of the house of representatives.

     (c)  The chair of the working group shall invite the following individuals to become members of the working group:

     (1)  Representatives of the health care industry; and

     (2)  Representatives of the travel industry.

     (d)  The working group shall:

     (1)  Develop acceptable use policies and guidelines for the regulation, development, deployment, and use of artificial technologies in the State;

     (2)  Work in conjunction with developments surrounding federal artificial intelligence regulation;

     (3)  Ensure safe, secure, and trustworthy artificial intelligence innovation;

     (4)  Identify and assess existing and potential risks associated with the development, deployment, and use of artificial intelligence systems and applications;

     (5)  Establish standards and guidelines for data privacy, security, and transparency in artificial intelligence systems; and

     (6)  Collaborate with public and private agencies, academic institutions, and industry stakeholders, on artificial intelligence technologies.

     (e)  The working group shall submit an interim report of its findings and recommendations, including any proposed legislation, to the legislature no later than December 31, 2024.

     (f)  The working group shall submit a final report of its findings and recommendations, including any proposed legislation, to the legislature no later than December 1, 2025.

     (g)  The working group shall cease to exist on June 30, 2026.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2024-2025 for the artificial intelligence working group to carry out its activities pursuant to this Act.

     The sum appropriated shall be expended by the office of enterprise technology services for the purposes of this Act.

     SECTION 3.  In accordance with section 9 of article VII of the Hawaii State Constitution and sections 37‑91 and 37‑93, Hawaii Revised Statutes, the legislature has determined that the appropriations contained in H.B. No.     , will cause the state general fund expenditure ceiling for fiscal year 2024‑2025 to be exceeded by $           or      per cent.  In addition, the appropriation contained in this Act will cause the general fund expenditure ceiling for fiscal year 2024‑2025 to be further exceeded by $           or      per cent.  The combined total amount of general fund appropriations contained in only these two Acts will cause the state general fund expenditure ceiling for fiscal year 2024‑2025 to be exceeded by $           or      per cent.  The reasons for exceeding the general fund expenditure ceiling are that:

     (1)  The appropriation made in this Act is necessary to serve the public interest; and

     (2)  The appropriation made in this Act meets the needs addressed by this Act.

     SECTION 4.  This Act shall take effect on July 1, 3000.
