A BILL FOR AN ACT
RELATING TO AGRICULTURE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 149A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§149A- Pesticide
inspection program; restricted use pesticides; banned pesticides. (a) The department shall establish and implement
a pesticide inspection program to:
(1) Increase compliance
with proper use of restricted use pesticides; and
(2) Ensure the
continued prohibition on the use or application of pesticides containing
chlorpyrifos pursuant to section 149A-31(7).
(b) In establishing the
pesticide inspection program, the department shall:
(1) Develop a system to conduct periodic
inspections or in response to a complaint to determine if any violations of
section 149A-31(3), (4), or (7) were committed; and
(d) The department shall adopt rules pursuant to chapter 91 necessary for the implementation of this section."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 3000.

Description:
Requires the Department of Agriculture to establish and implement a pesticide inspection program to increase compliance with the proper use of restricted use pesticides and ensure the continued prohibition on the use or application of pesticides containing chlorpyrifos. Requires the Department to post the inspection results on its website upon completion of a final order for a violation. Effective 7/1/3000. (SD2)
