A BILL FOR AN ACT
relating to air pollution.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 342B, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:
"§342B- Air
quality testing; waste management facilities. (a) Notwithstanding any other law to the
contrary, the department shall conduct continuous air quality testing at waste
management facilities for the following chemicals:
(1) Ammonia;
(2) Dioxins and
furans;
(3) Polychlorinated
biphenyls;
(4) Perfluoroalkyl
and polyfluoroalkyl substances;
(5) Polycyclic
aromatic hydrocarbons;
(6) Hydrochloric
acid;
(7) Hydrogen
fluoride;
(8) Volatile
organic compounds;
(9) Arsenic;
(10) Beryllium;
(11) Cadmium;
(12) Chromium (VI);
(13) Lead;
(14) Manganese;
(15) Mercury;
(16) Nickel;
(17) Selenium; and
(18) Zinc;
provided that this subsection shall not prevent
the department from testing for other chemicals, pollutants, opacity, or
particulate matter.
For the purposes of this subsection,
"waste management facility" includes but is not limited to solid
waste disposal facilities and solid waste reduction facilities, as defined in
section 342G-1.
(b) The department shall establish rules pursuant
to chapter 91 to implement this section, including frequency of continuous
testing."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2024-2025 for air quality testing at waste management facilities pursuant to this Act.
The sum appropriated shall be expended by the department of health for the purposes of this Act.
SECTION 3. In accordance with section 9 of article VII of the Hawaii State Constitution and sections 37‑91 and 37‑93, Hawaii Revised Statutes, the legislature has determined that the appropriations contained in H.B. No. , will cause the state general fund expenditure ceiling for fiscal year 2024‑2025 to be exceeded by $ or per cent. In addition, the appropriation contained in this Act will cause the general fund expenditure ceiling for fiscal year 2024‑2025 to be further exceeded by $ or per cent. The combined total amount of general fund appropriations contained in only these two Acts will cause the state general fund expenditure ceiling for fiscal year 2024‑2025 to be exceeded by $ or per cent. The reasons for exceeding the general fund expenditure ceiling are that:
(1) The appropriation made in this Act is necessary to serve the public interest; and
(2) The appropriation made in this Act meets the needs addressed by this Act.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect on July 1, 2024.
