A BILL FOR AN ACT

 

 

relating to environmental protection.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 342D, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:

     "§342D-     Septic systems in the agricultural district; prohibited.  Any development or structure constructed on a subdivision of land in the agricultural district on or after January 1, 2025, shall not include any septic system at the time of the original construction or through subsequent renovation or reconstruction.

     "Development" shall have the same meaning as defined in section 46-141.

     "Septic system" means an individual wastewater system that typically consists of a septic tank, piping, and a drainage field where there is natural biological decontamination as wastewater discharged into the system is filtered through soil.

     "Structure" shall have the same meaning as defined in section 514B-3."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
