A BILL FOR AN ACT

 

 

relating to hospitals.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 321-14.5, Hawaii Revised Statutes, is amended by amending subsection (d) to read as follows:

     "(d)  The rules shall [provide]:

     (1)  Provide that the department may conduct inspections and investigations of exempt hospitals to investigate complaints, follow up on adverse accreditation findings, or conduct periodic validation surveys[.]; and

     (2)  Require that each hospital holding a license pursuant to this section have, at all times, at least one trained security guard or off-duty law enforcement officer working as a security guard positioned at each entrance to the hospital, including emergency room entrances; provided that each trained security guard or off-duty law enforcement officer working as a security guard shall be trained, to the satisfaction of the department, in the use of weapons, defensive tactics, de-escalation techniques, appropriate physical restraint techniques, crisis intervention, and trauma-informed approaches to identifying and safely addressing situations involving patients, family members, or other persons who pose a risk of harm to themselves or others due to mental illness or substance abuse or who are experiencing a mental health crisis."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
