A BILL FOR AN ACT

 

 

relating to A green user fee program.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 184, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§184-     Green user fee program; mobile application.  (a)  The department shall establish a green user fee program to collect user fees, including film permitting fees, for state parks identified by the department.  User fees collected pursuant to this section shall be deposited into the state parks special fund under section 184-3.4.  A county may request to have a county park participate in the green user fee program; provided that if the county charges a user fee, the fee shall be collected by the department and remitted to the appropriate county.

     (b)  The department shall develop a mobile application for the green user fee program to manage reservations and collect user fees for state parks identified by the department.

The mobile application shall be available in multiple languages including but not limited to:

     (1)  Traditional and simplified Chinese;

     (2)  Japanese;

     (3)  Korean; and

     (4)  Tagalog.

     (c)  This section shall not apply to an individual who has:

     (1)  Filed or paid state income taxes for the immediately previous tax period; or

     (2)  Established domicile in the State, as evidenced by documentation showing the individual's address, including any of the following:

          (A)  A valid state driver's license;

          (B)  A valid state civil identification card;

          (C)  A valid school identification card; or

          (D)  Any other official document issued to the individual by a government agency, financial institution, insurance company, or utility company in the State."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 to establish the reservation and fee collection system, including the mobile application, as required by this Act.

     The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $             or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for four full-time equivalent (4.0 FTE) positions, to be allocated as follows:

     (1)  $           for one full-time equivalent (1.0 FTE) administrator of the green user fee program;

     (2)  $           for one full-time equivalent (1.0 FTE) administrative assistant of the green user fee program;

     (3)  $           for one full-time equivalent (1.0 FTE) green user fee coordinator to coordinate with the counties for the green user fee program; and

     (4)  $           for one full-time equivalent (1.0 FTE) film permitting liaison.

     The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2023.
