A BILL FOR AN ACT
relating to mopeds.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
The purpose of this Act is to, beginning January 1, 2025, prohibit a retailer from selling or offering for sale any combustion engine-powered moped unless the moped was initially purchased in a consumer transaction prior to January 1, 2025.
SECTION 2. Chapter 286, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:
"§286- Sale
of new combustion engine-powered mopeds; prohibited; civil penalty;
enforcement. (a) Beginning January 1, 2025, no retailer
shall sell or offer for sale any combustion engine-powered moped unless the
moped was initially purchased in a consumer transaction prior to January 1, 2025.
(b)
This section shall not be construed to prohibit any individual or
retailer from reselling, renting, or offering for resale or rent a combustion
engine‑powered moped that was initially purchased in a consumer
transaction prior to January 1, 2025.
(c)
Any person who violates this section shall be fined not more than $1,000
for each separate offense. Each
violation shall constitute a separate offense.
(d) For purposes of this section "retailer" means a person or entity that engages in the practice of selling mopeds to consumers."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
