Beginning 7/1/2024, subjects all electric vehicles to a state mileage-based road usage fee instead of paying a registration surcharge.  Requires a vehicle inspection certificate to state the odometer reading of the vehicle.  Clarifies that the type of fuel required on applications for vehicle registration includes batteries or electricity.  Requires the department of transportation to develop a long-term mileage-based usage fee implementation plan for all passenger vehicles and light duty trucks by 2033.  Requires the department of transportation to seek federal funding.  Appropriates American Rescue Plan Act funds for the state mileage-based road usage fee program.

Establishes a two-year infant and toddler child care contracted slots pilot program to develop and implement procedures to subsidize child care slots in licensed infant and toddler child care settings. Requires reports to the legislature.

Allows greater flexibility in conditions placed on eligibility requirements for the motion picture, digital media, and film production income tax credit.  Amends the amount of the total tax credit that may be claimed per qualified production.  Amends the annual aggregate cap placed on the amount of the tax credits that may be claimed by qualified productions.

Authorizes naturopathic physicians to provide written certification to qualifying patients for the medical use of cannabis.  Clarifies provisions regarding the establishment of bona fide physician-patient, naturopathic physician-patient, and advanced practice registered nurse-patient relationships via telehealth.

RELATING TO HEALTH DATA SHARING.

Establishes the Hawaii health data exchange framework.  Establishes the stakeholder advisory group to assist the department of health in the development of the framework.  Requires certain health care organizations to execute a health data sharing agreement by 9/1/2024.  Establishes deadlines for certain entities to begin sharing health information.  Appropriates funds.

RELATING TO MEDICAL INFORMED CONSENT.

Requires the Hawaii Medical Board to establish standards for health care providers to ensure that a patient's consent to treatment is an informed consent.  Requires that informed consent for a proposed medical or surgical treatment or a diagnostic or therapeutic procedure shall be obtained prior to the day of that treatment or procedure.  Specifies that if the treatment or procedure is to occur on the same day it is scheduled, the informed consent shall be obtained at the time the decision is made to schedule that treatment or procedure.

RELATING TO DENTISTS AND DENTAL HYGIENISTS.

Amends the qualifications for dentist community service licenses and dentist temporary licenses by requiring the acceptance of candidates who are graduates of a dental college recognized by the American Dental Association Commission on Dental Accreditation.  Amends the qualifications for dental hygienist community service licenses by requiring acceptance of candidates who are graduates of a dental hygiene college recognized by the American Dental Association Commission on Dental Accreditation.  Adds community health centers to the list of eligible organizations that may employ a dental provider with a community service license.

RELATING TO PROCUREMENT.

Amends the competitive sealed bidding process for construction projects to require joint contractors and subcontractors to submit their bids to a bid depository established under DCCA.  Authorizes joint contractors and subcontractors to submit different bids to different general contractors bidding on the project.  Requires all bids submitted by joint contractors and subcontractors to be held in the bid depository and withheld from the general contractors until twenty-four hours before the closing of the invitation for bids.  Requires general contractors to use only the bids timely submitted by joint contractors and subcontractors to the bid depository in their construction bid and imposes fines for violations.  Requires DCCA to adopt rules specifying how the bid depository shall operate.

Establishes a tax equal to seventy per cent of the manufacturer's list price for electronic smoking devices and e-liquid products.  Expands the electronic smoking device retailer registration unit to include wholesalers.  Requires electronic cigarette wholesalers to register with the electronic smoking device retailer and wholesaler registration unit.

RELATING TO RESIDENTIAL REAL PROPERTY.

Authorizes planning or permitting agencies to enter privately owned residential real property, under certain specified conditions, to address violations of county zoning ordinances, rules, or regulations.  Specifies that a property owner who receives a notice of violation and fails to remediate the violation within the county planning or permitting agency's specified time frame shall be fined a minimum of $1,000 per day, subject to a lien if the fines exceed $5,000, and subject to foreclosure proceedings if the property owner does not satisfy the lien within thirty days of notice and commence remediation of the violation.

RELATING TO MEDICARE SUPPLEMENT INSURANCE.

Requires issuers of Medigap insurance in the State to accept an eligible individual's application for coverage at any time throughout the year and prohibits issuers from denying the applicant a Medigap policy or certificate or make any premium rate distinctions because of health status.  Requires the Insurance Commissioner to amend or adopt rules accordingly.

Establishes the Erin's law task force to review policies, programs, and curricula for educating public school students about sexual abuse and sex trafficking prevention, report recommendations for the establishment of a program to educate public school children on sexual abuse prevention through age-appropriate curricula, provide relevant training to teachers and school staff, and inform parents and guardians about important child sexual abuse topics.  Requires the Department of Education to establish and implement a systemwide sexual abuse prevention education program at the conclusion of the task force.

Requires that University of Hawaii students and employees receive training on sexual misconduct awareness and trauma informed responses, sexual harassment, sexual assault, domestic violence, dating violence, and stalking.  Requires that the University of Hawaii ensure that any individual who participates in implementing the university's disciplinary process has training or experience in handling sexual misconduct complaints and the university's disciplinary process.  Requires that the university provide mandatory annual trauma informed, gender inclusive, LGBTQ+ inclusive sexual misconduct primary prevention and awareness programming for students and employees of the university.  Prohibits the university from taking disciplinary action against individuals reporting sexual misconduct unless certain exceptions apply.

Makes the sale of gasoline for an unconscionably excessive price during periods of abnormal disruption of the market an unfair trade practice.  Increases penalties for violations of the law regulating unfair trade practices by the petroleum industry.  Authorizes the courts to order all or a portion of any civil penalty imposed to be deposited into the energy security special fund.

Expands the coffee labeling and advertising requirements to include ready-to-drink coffee beverages and inner packages and inner wrapping labels.  Requires disclosure on the label of coffee blends of the respective geographic and regional origins and per cent by weight of the blended coffees.  Prohibits use of the term "All Hawaiian" in labeling or advertising for roasted coffee or instant coffee not produced entirely from green coffee beans grown and processed in Hawaii.

Authorizes the Department of Hawaiian Home Lands to issue interim rules that exempt from the public notice, public hearing, and gubernatorial approval requirements of chapter 91, HRS, after beneficiary consultation is conducted by the Department of Hawaiian Home Lands and upon approval by the Hawaiian Homes Commission.  Limits effective time period of the interim rules to not more than eighteen months.

RELATING TO THE INTERSTATE MEDICAL LICENSURE COMPACT.

Adopts the Interstate Medical Licensure Compact to create a comprehensive process that complements the existing licensing and regulatory authority of state medical boards and provides a streamlined process that allows physicians to become licensed in multiple states, thereby enhancing the portability of a medical license and ensuring the safety of patients.

RELATING TO THE NURSE LICENSURE COMPACT.

Allows the Governor to enter the State into the multi-state Nurse Licensure Compact, which will allow a nurse who is licensed by a home state to practice under a multi-state licensure privilege in each party state.

RELATING TO HOUSING.

Conditions the authority of a county whose population is greater than five hundred thousand to exercise state housing powers upon a county's continued compliance with provisions regarding acceptance of the dedication of infrastructure and public highways in affordable housing developments.  Amends various provisions relating to the dedication of infrastructure to a county.

RELATING TO GOVERNMENT.

Expands the jurisdiction of county land use decision-making authorities, enabling them to amend the district boundaries of lands less than fifty acres, from lands less than fifteen acres.  Limits the Land Use Commission's authority over special permits for housing that includes workforce or affordable housing units with a minimum twenty-five per cent of market units on land the area of which is greater than fifty acres or for lands designated as important agricultural lands, by providing that the Land Use Commission shall only add additional restrictions or disapprove a petition.  Requires the Land Use Commission to run its special permit process concurrently with the appropriate county Land Use Commission for these special permits.

Specifies that a simple majority of affirmative votes by members of the land use commission is required for any boundary amendment.  Reduces the number of days by when the land use commission must act for certain actions related to amendments to district boundaries.

Requires the school facilities authority to conduct a feasibility study for the development of teacher and workforce housing at the Queen Liliuokalani elementary school property.  Requires a report to the legislature prior to the 2024 regular session.  Appropriates funds for the feasibility study.
