Clarifies that a developer is responsible for ensuring that the use of out-of-state time share units for time sharing purposes complies with zoning and land use laws and rules of the jurisdiction where the time share units are located but is not required to submit evidence of such compliance to register in Hawaii.

For time share plans that use title-holding trusts, requires the developer to submit a title report evidencing that the title vested in the trustee.  For time share plans that use a notice of time share plan, requires the recordation of the notice and its submission.  For time share plans that use alternative arrangements, requires the recordation of any alternative arrangement documents.

RELATING TO LAND.

Authorizes the board of land and natural resources to: (1) Amend and extend existing pasture leases for up to sixty-five years; (2) Issue new pasture leases by negotiation, if the lands are already under pastoral use; and (3) Develop agricultural and pasture lease rents based on the value of the land's agricultural uses.  Specifies that agricultural multi-use lands under the management of the department of land and natural resources are not subject to transfer to and management by the department of agriculture.  Before the transfer of non-agricultural park lands, authorizes the department of agriculture to request information from the department of land and natural resources related to the establishment of necessary and reasonable easements upon the lands.  Requires the board of land and natural resources to revise its land classifications to include agricultural multi-use lands.  Requires as a condition precedent for any valid withdrawal of lands out of pasture leases for reforestation purposes that the division of forestry and wildlife submit a funded action plan detailing the planned reforestation process for those lands and that the withdrawal be approved by the board of land and natural resources.  Establishes and appropriates funds for an agricultural multi-use lands specialist position.

RELATING TO REAL PROPERTY LIENS.

Authorizes the State and the county in which the affected real property is situated to place a lien on the property for unpaid civil fines resulting from a violation of a land use law in connection with the property.  Authorizes the State and applicable county to sell the property after all notices, orders, and appeal proceedings, if any, are exhausted and use those revenues to pay unpaid civil fines related to that property.

Establishes and appropriates funds for a two-year program at the University of Hawaii to study the impact of sandbag walls, or "sand burritos", on sand movement patterns and coastal erosion at Ehukai beach park on the north shore of Oahu.  Establishes a temporary moratorium on the use of sandbag walls or "sand burritos", unless authorized by an emergency permit from the department of land and natural resources.  Requires report to legislature.  Appropriates funds.

Amends section 11-357, HRS, to prohibit elected officials as defined in section 11-342(d), HRS, from soliciting and accepting campaign contributions during any regular session or special session of the State Legislature, including any extension of any regular session or special session and any legislative recess day, holiday, or weekend.

RELATING TO ORDERS OF THE CAMPAIGN SPENDING COMMISSION.

Amends section 11-410, HRS, by:  (1) amending subsection (b) to provide that a person waives the right to a contested case hearing if the person fails to request a contested case hearing within 20 days of receipt of the Commission's preliminary determination; and (2) amending subsection (d) to provide that a final order of the Commission may be filed in the First Circuit Court for confirmation as a civil judgment, enforceable and collectible as any other judgment issued by the circuit courts.

RELATING TO VIOLATIONS OF CAMPAIGN FINANCE LAW.

Increases the amount of fine from $1,000 to $5,000 that may be assessed against a noncandidate committee making only independent expenditures that has received at least 1 contribution of more than $10,000, or spent more than $10,000 in an election period, for campaign spending law violations.  Allows the Campaign Spending Commission to order the fine be up to 3 times the amount of the unlawful contribution or expenditure, and to order that the payment of the fine assessed against a noncandidate committee, or any portion thereof, be paid from the personal funds of an officer of the noncandidate committee.

Amends sections 11-322 and 11-333, Hawaii Revised Statutes, to require the Campaign Spending Commission ("Commission") to publish on its website the names of candidate and persons who qualify as noncandidate committees who fail to file an organizational report or a corrected organizational report with the Commission.

Increases the amount of partial public financing available for all offices.  Amends section 11-425, HRS, by increasing the maximum amount of public funds available for all offices by 50%.  Increases the maximum amount of public funds available for a candidate for the Office of Hawaiian Affairs from $1,500 to 10% of the expenditure limit established in section 11-423(d), HRS, for each election.  Amends section 11-429(a), HRS, by increasing the amounts of qualifying contributions for the Office of Hawaiian Affairs from more than $1,500 in the aggregate to more than $5,000 in the aggregate.  Provides a downward adjustment of the amounts of qualifying contributions for the Office of Prosecuting Attorney for the City and County of Honolulu, County of Hawaii, and County of Kauai and for the Office of County Council for the County of Maui.  Appropriates unspecified sums for each of the 2 fiscal years of the next biennium to pay for the increase in the partial public financing program.  Appropriates $200,000 for each of the 2 fiscal years of the next biennium for the Commission to hire 2 additional staff members.

Authorizes licensed osteopathic physicians and physician assistants, in addition to physicians and advance practice registered nurses, to provide minor-initiated medical care and services.  Requires the licensed health care provider to ensure that the covered entity has been notified that minor-initiated medical care and services should not be disclosed.  Requires the covered entity to have policies and procedures established to maintain nondisclosure of the minor-initiated medical care and services to the minor's parent or legal guardian.  Authorizes the licensed health care provider to submit a claim to the covered entity for the provision of minor-initiated medical care and services.

RELATING TO CHILDHOOD SEXUAL ABUSE.

Clarifies provisions related to the statutory limitations on the time periods in which a survivor of childhood sexual abuse may file a civil action.  Allows for punitive damages.  Permits the court to order restorative justice measures, if deemed appropriate.

Requires psychologists licensed in the State to complete at least four hours of continuing education per licensing biennium on topics relating to cultural diversity, cultural competence, sexual orientation, gender identity, or health equity.  Requires psychologists seeking renewal of their license in the State without full compliance with the continuing education requirement to have completed at least seven hours of continuing education in the next licensing biennium on topics relating to cultural diversity, cultural competence, sexual orientation, gender identity, or health equity.

RELATING TO TRAUMA-INFORMED CARE.

Establishes a trauma-informed care task force within the Department of Health.  Requires the task force to develop a statewide framework for trauma-informed care and to provide other recommendations on how the State can implement best practices in trauma-informed care, including native Hawaiian cultural practices.  Provides that the trauma-informed care task force shall serve as an advisory board for, and be administratively attached to, the office of wellness and resilience established in section 27-62, Hawaii Revised Statutes.  Requires the task force to submit a report to the Legislature no later than 20 days prior to the convening of each regular session.

RELATING TO THE OFFICE OF WELLNESS AND RESILIENCE.

Transfers the Office of Wellness and Resilience from the Office of the Governor to the Department of Human Services on 7/1/2025.  Extends the Trauma-Informed Care Task Force dissolution date to 6/30/2025 and establishes the task force as an advisory board to the Office of Wellness and Resilience until its dissolution.  Reconstitutes the membership of the Trauma-Informed Care Task Force into a permanent advisory board to the Office of Wellness and Resilience to be called the Wellness and Resilience Advisory Board.

RELATING TO AQUACULTURE.

Establishes within the Department of Agriculture, an Aquacultural Area Lease Program for the purpose of identifying state facilities, state lands, and state marine waters that are suitable for use and lease as commercial aquacultural areas.  Allows agencies having control and management of identified aquacultural areas to lease the facilities, lands, and waters to the Department of Agriculture for the purposes of the Act.  Allows the program to use the moneys in the Aquaculture Development Special Fund to carry out the purposes of the Act and requires the revenues obtained from aquacultural area leases to be deposited into the Aquaculture Development Special Fund.  Imposes penalties and civil and criminal liabilities.  Exempts the program from being subject to the Hawaii Ocean and Submerged Lands Leasing Act.

RELATING TO AQUACULTURE.

Requires the Animal Industry Division of the Department of Agriculture to administer an assessment and approval process to import and move aquatic livestock in the State.  Requires the Animal Industry Division to develop a risk-based framework for the aquatic livestock assessment and approval process and to undertake certain activities to develop and expand the aquaculture industry.  Defines aquatic biorisk, aquatic livestock, and biocontainment.

RELATING TO FAMILY LEAVE.

Provides employed individuals with up to 8 weeks of paid family leave during the 1st year after birth of the individual's child, adoption of a child by the individual, or placement of a child with the individual through foster care, and 8 weeks of paid family leave to care for the individual's family member having a serious health condition during any benefit year, paid through an employer-based private insurance program currently used to provide for temporary disability benefits.  Specifies that private employers having fewer than 200 employees shall not be required to provide family leave and family leave benefits.  Repeals chapter 398, HRS.  Appropriates funds to the Department of Labor and Industrial Relations.  Sections 1-28 effective 7/1/2025.
