RELATING TO FISHING SAFETY.

Prohibits purposeful harassment with the intent to prevent the taking of fish by persons who are fishing in state waters.

RELATING TO COMMERCIAL FISHING.

Authorizes the department of land and natural resources to establish limited entry commercial fisheries where appropriate or necessary to ensure certain commercial fisheries throughout the State remain healthy and sustainable while balancing the important economic role of commercial fisheries in the State.

SB 44

      Status & Testimony

RELATING TO STATE WATER CODE PENALTIES.

Adds a minimum penalty of $50 per violation of the State Water Code and makes each day that a violation exists or continues a separate offense.  Requires the Commission on Water Resource Management to determine the amount of the penalty based on the circumstances of the violation.

SB 1377

      Status & Testimony

RELATING TO WATER POLLUTION CONTROL.

Revises chapter 342D, Hawaii Revised Statutes, to add wetlands to the definition of State waters, clarifies the Director of Health's role as a certifying agency including enforcement of water quality certifications, and increases certain statutory civil penalties.

RELATING TO DECLARATION OF WATER SHORTAGE AND EMERGENCY.

Clarifies the conditions, manner, and areas in which the Commission on Water Resource Management of the Department of Land and Natural Resources can declare water shortages and emergencies.

RELATING TO FRESH WATER SECURITY.

Establishes within the Department of Land and Natural Resources a Water Security Working Group to study and recommend priority capital improvement projects for legislative consideration and approval that leverage public-private investment to increase Hawaii's water security.  Makes an appropriation.

RELATING TO ENVIRONMENTAL PROTECTION.

Establishes a task force to examine the consequences of drinking water contamination detected at the Waipahu Wells II Granular Activated Carbon Treatment Facility.  Appropriates funds.

RELATING TO PROTECTION OF STREAMS.

Prohibits dispositions that authorize diverting water from East Maui county streams for commercial purposes, except for existing water uses by the Maui County Department of Water Supply.

SB 1064

RELATING TO DAM AND APPURTENANCE SAFETY.

Establishes the dam and appurtenance loan and grant programs for plans, design, construction, and equipment that is used to improve deficient dams and appurtenances as determined by the Department of Land and Natural Resources and approved by the Board of Land and Natural Resources.  Specifies eligibility requirements for dam and appurtenance improvement grants.  Establishes the dam and appurtenance improvement tax credit for expenditures for dam and appurtenance improvements that bring dams and appurtenances up to code.  Appropriates funds.

SB 1153

      Status & Testimony

RELATING TO HONOLUA BAY.

Establishes the Honolua Bay Special Fund for conservation purposes and the upkeep and maintenance of Lipoa Point.  Establishes a Honolua Bay Advisory Board to administer the Honolua Bay Special Fund and oversee the conservation of Honolua Bay.  Requires the Department of Land and Natural Resources to include and incorporate Honolua Bay into the Division of State Parks' online reservation system.  Makes an appropriation.

      Status & Testimony

RELATING TO BEACH PARK RESTORATION.

Appropriates funds for a grant-in-aid to the County of Hawaii to hire an engineering firm to study, plan, assist, and conduct preliminary design and concept work for a two-phase project to restore the Kahaluu Beach Park in the County of Hawaii.  Conditions the appropriation on the County of Hawaii contribution of matching funds.

      Status & Testimony

RELATING TO MARINE LIFE CONSERVATION DISTRICTS.

Requires the Department of Land and Natural Resources to establish and conduct the Marine Life Conservation District Carrying Capacity Program.  Requires the Department of Land and Natural Resources to submit reports to the Legislature.  Appropriates funds.

      Status & Testimony

RELATING TO CORAL REEF INSURANCE.

Appropriates funds for a three-year continuation of the wind-generated storm damage reef-insurance policy purchased by The Nature Conservancy in November 2022.

RELATING TO THE KAIWI COAST.

Designates the Kaiwi Coast Scenic Shoreline and adjacent lands as the Kaiwi Coast State Park. Establishes protection and directions for land management and positions within the Department of Land and Natural Resources.  Appropriates funds.

      Status & Testimony

RELATING TO THE DEPARTMENT OF LAND AND NATURAL RESOURCES.

Requires the department of land and natural resources to develop and implement a management system for Ka‘ena point state park, Makua, and Keawa‘ula regions.  Appropriates funds.

      Status & Testimony

RELATING TO PORT INFRASTRUCTURE.

Requires the department of land and natural resources to create a strategic plan for maintenance dredging of important port and harbor locations and report the plan to the legislature.  Requires the department of land and natural resources to complete a minimum of two projects identified in the strategic plan.  Appropriates funds.
