Status

RELATING TO STATE WATER CODE PENALTIES.

Creates a minimum penalty of $50 for every violation of the State Water Code.  Raises the maximum penalty to $25,000 for every violation of the State Water Code.  Clarifies that each day a violation exists or continues is a separate offense.  Requires the Commission on Water Resource Management to determine the amount of the penalty based on the circumstances of the violation.  Appropriates funds for two-full-time equivalent (2.0 FTE) general professional positions in the Commission on Water Resource Management.  Effective 7/1/2050.  (SD2)

Status

RELATING TO COMMERCIAL ACTIVITIES ON BEACHES.

Prohibits any commercial vendor from presetting commercial beach equipment on any public beach under the jurisdiction of the Department of Land and Natural Resources, unless the customer is physically present.  Requires commercial vendors to expeditiously remove commercial beach equipment after the customer has finished using it.  Allows the Department of Land and Natural Resources to grant exemptions through rules.  Establishes administrative fines for violations.  Pertains only to public beaches and does not include private lands such as accreted lands.  Effective 7/1/2050.  (SD1)

RELATING TO THE HAWAII EMERGENCY MANAGEMENT AGENCY.

Authorizes the Hawaii Emergency Management Agency to acquire any real, personal, or mixed property for immediate or future use; own, hold, improve, rehabilitate, sell, assign, exchange, transfer, convey, lease, or dispose of any real, personal, or mixed property acquired; and acquire by condemnation real property for immediate or future use.  Amends the definition of "public lands" to exclude lands to which the Hawaii Emergency Management Agency holds title.  Effective 7/1/2050.  (SD1)

RELATING TO SEARCH AND RESCUE.

Requires government entities to seek reimbursement for search and rescue expenses for persons who require rescue after ignoring warning signs, leaving a hiking trail to enter a prohibited area, or hiking on a trail closed to the public.  Takes effect 1/1/2050.  (SD1)

Grants the Department of Agriculture the statutory power to own land/property for immediate or future use.

RELATING TO EDUCATION.

Authorizes the counties to transfer land to the School Facilities Authority.  Exempts the School Facilities Authority from taxes.  Authorizes state and county agencies to render services to the School Facilities Authority upon request.  Authorizes the School Facilities Authority to engage in commercial enterprise activities for the purpose of revenue generation.  Authorizes the School Facilities Authority to contract to manage leasing and management of housing projects.  Establishes a deadline for the transfer of properties to the Department of Education from the City and County of Honolulu required by Act 206, SLH 2017, as amended by Act 272, SLH 2019.  (SD2)

RELATING TO THE WAHIAWA IRRIGATION SYSTEM.

Requires the Office of the Governor to negotiate the State's fee simple acquisition of the Wahiawa irrigation system on the island of Oahu.  Authorizes and appropriates funds for the Department of Agriculture, Agribusiness Development Corporation, and Department of Land and Natural Resources to purchase, repair, and maintain the Wahiawa irrigation system and the associated spillway.  Appropriates funds four full-time equivalent (4.0 FTE) positions for the Department of Land and Natural Resources.  Effective 7/1/2050.  (SD2)

RELATING TO THE KAIWI COAST.

Designates the Kaiwi State Scenic Shoreline and adjacent lands as the Kaiwi Coast State Park.  Establishes protection and guidance for land management and funds 2 full-time equivalent (2.0 FTE) positions within the Department of Land and Natural Resources.  Appropriates funds.  Effective 7/1/2050.  (SD2)

RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY.

Increases options to build affordable housing in Hawaii Community Development Authority districts by increasing the permissible lease term to 99 years.  Prohibits the Hawaii Community Development Authority from encumbering lands that were classed as crown or government lands prior to 8/15/1895, in leases longer than 65 years.  Effective 7/1/2050.  (SD1)

RELATING TO DAM AND APPURTENANCE SAFETY.

Establishes the dam and appurtenance improvement or removal grant program for plans, design, construction, and equipment that is used to improve or remove deficient dams and appurtenances as determined by the Department of Land and Natural Resources and approved by the Board of Land and Natural Resources.  Specifies eligibility requirements for dam and appurtenance improvement or removal grants.  Appropriates funds.  Effective 7/1/2050.  (SD2)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
