RELATING TO AQUATIC RESOURCES.

Appropriates funds for coral reef restoration and habitat enhancement efforts of the department of land and natural resources.

RELATING TO NATIVE HAWAIIAN TRADITIONAL AND CUSTOMARY FISHING PRACTICES.

Authorizes the department of land and natural resources to issue special activity permits for the purpose of recognizing and protecting individuals exercising their Native Hawaiian traditional and customary rights.

Status

RELATING TO AQUATIC RESOURCES.

Expands the department of land and natural resources' rulemaking authority to include any rule deemed necessary to protect certain aquatic life.  Expands the board of land and natural resources' authority to temporarily adopt, amend, or repeal certain natural resource rules by formal action at a publicly noticed meeting if the board finds that such adoption, amendment, or repeal is necessary to implement effective and adaptive management measures in response to new or previously benign aquatic nuisance species, in light of newly available technology, or in light of newly available data.  Creates new fines for violations of rules pertaining to the department's prevention of or response to previously benign aquatic nuisance species.  Authorizes the department to prevent or respond to threats from aquatic nuisance species from all discharges incidental to the normal operation of a vessel, not just ballast water and hull fouling.

RELATING TO NATURAL RESOURCES.

Requires the commission on water resource management and division of aquatic resources of the department of land and natural resources, in partnership with the University of Hawaii, to conduct research on limu to understand the impacts of groundwater use on groundwater-dependent ecosystems.  Requires report to legislature.  Appropriates funds.

Requires the Commission on Water Resource Management to conduct an audit of the State's surface water transmission systems.

Prohibits commercial ocean use activity in Kaneohe Bay waters without a permit.  Prohibits any person from advertising any commercial ocean use activity in Kaneohe Bay waters for which the person does not have a permit, lease, or license.

RELATING TO OCEAN RECREATION COMMERCIAL PERMITS.

Specifies the methods by which the Department of Land and Natural Resources can issue new ocean recreation commercial permits and renew existing ocean recreation commercial permits.  Specifies that new permits for ocean recreation management areas and facilities where a permit limit is implemented, new permits will be issued by the method enumerated and in the order set forth herein until the limit is reached.  For renewal of existing permits in ocean recreation management areas and facilities where a permit limit is implemented, the ability to renew a commercial permit will be based on seniority until the limit is reached.

RELATING TO A STATE BOATING FACILITY LEASE PILOT PROGRAM.

Establishes a state boating facility lease pilot program within the Department of Land and Natural Resources (Department).  Clarifies that a private partner under lease or contract with the Department may assist with development, management, and maintenance of a state small boat harbor.

Status

RELATING TO STORMWATER FEES.

Exempts the State and its departments and agencies that maintain or operate a stormwater management system that is interconnected to a county stormwater system from county stormwater user fees.  Prohibits each county from denying services to the State or its departments or agencies by reason of nonpayment of user fees.

RELATING TO THE WATER POLLUTION CONTROL SPECIAL FUND.

Establishes the Water Pollution Control Special Fund to collect fees formerly deposited to the State general fund to create a supplemental source of funding to implement and enforce water quality management as implemented in permits, certifications, and variances.  Appropriates funds to be used by the Department of Health for the purposes of the Water Pollution Control Special Fund.

RELATING TO FUNDS.

Reinstates Governor's authority to transfer funds to cope with the effects of natural disasters, for operating purposes, or to supplement the Department of Land and Natural Resources' Fire Fighter's Contingency Fund.

RELATING TO EMERGENCY MANAGEMENT.

Clarifies the scope of the Comprehensive Emergency Management Plan; delineates allowable uses of Major Disaster Fund monies; increases the amount of the additional funds that may be made available for the purpose of matching federal disaster relief fund from $5,000,000 to $10,000,000; shortens the duration of price control periods from 96 hours to 72 hours; defines "Severe Warning"; and clarifies that entities other than the National Weather Service issue warnings that may require the activation of the emergency management system.

RELATING TO HOMELAND SECURITY.

Establishes protections for critical infrastructure information that is received or maintained by the Office of Homeland Security for use regarding the security of critical infrastructure.

RELATING TO HOMELAND SECURITY.

Formally establishes the Hawaii State Fusion Center as a program under the Office of Homeland Security to be transferred to the Department of Law Enforcement and delineates its roles and responsibilities.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
