RELATING TO VISITOR IMPACT FEES.

Establishes the Visitor Impact Fee Program within the Department of Land and Natural Resources, through which the department will collect a fee from visitors for a license to visit a state park, forest, hiking trail, or other state natural area.  Establishes, and appropriates moneys into and out of, the Visitor Impact Fee Special Fund.  Effective 7/1/2050.  (SD2)

RELATING TO TIME SHARING PLANS.

Specifies that primary and secondary plan documents be listed in the public disclosure statement of a time share plan.  Clarifies the manner in which the required disclosure of liens, title defects, or encumbrances on the titles of units may be made.  Provides that a review of encumbrances shall be waived upon the certification from the developer that the time share interest is free and clear of blanket liens or that identifies all blanket liens.  Effective 7/1/2050.  (SD1)

RELATING TO TIME SHARING.

Clarifies that a developer is responsible for ensuring that the use of out-of-state time share units for time sharing purposes complies with zoning and land use laws and rules of the jurisdiction where the time share units are located but is not required to submit evidence of such compliance to register in Hawaii.  Effective 7/1/2050.  (SD1)

RELATING TO TIME SHARING PLANS.

For time share plans that use title-holding trusts, requires the developer to submit a title report evidencing that the title is vested in the trustee.  For time share plans that use a notice of time share plan, requires the recordation of the notice and its submission.  For time share plans that use alternative arrangements, requires the recordation of any alternative arrangement documents.  Effective 7/1/2050.  (SD1)

RELATING TO THE HAWAII TOURISM AUTHORITY.

Requires contracts entered into by the Hawaii Tourism Authority for management of the Hawaii Convention Center facility to include marketing for all uses of the facility.  Effective 7/1/2050.  (SD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair is instituting a 2 minute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
