RELATING TO CRIMINAL JUSTICE DATA SHARING.

Establishes a criminal justice data sharing working group to make recommendations for a statewide criminal justice data repository.

RELATING TO PROBATION.

Establishes the Hawaii Opportunity Probation with Enforcement Program to be administered by the Judiciary.

RELATING TO TELEPHONE SERVICES FOR COMMITTED PERSONS.

Prohibits the Department of Public Safety from receiving any commission payment from telephone service providers based on inmate phone calls.  Prohibits the Department of Public Safety from entering into or renewing any contract with any privately owned prison telephone communications provider.

SB 372

      Status & Testimony

RELATING TO GOVERNMENT SERVICES RELATING TO THE LAW.

Provides that a law enforcement officer has a duty to intervene if the law enforcement officer reasonably believes that another law enforcement officer is using or is about to use unnecessary or excessive force on an arrestee.  Requires the law enforcement officer to report the incident to the fellow law enforcement officer's supervisor.  Requires relevant departments to submit annual reports to the Legislature.

      Status & Testimony

RELATING TO THE HAWAII CORRECTIONAL SYSTEM OVERSIGHT COMMISSION.

Requires the Hawaii Correctional System Oversight Commission to review and recommend amendments to the Department of Public Safety's operating budget request and any capital improvement project appropriation requests prior to each legislative session.  Requires the Commission to inform the Legislature if its recommendations were not accepted.  Requires the Commission to advise the Governor as to whether the Department of Public Safety's expenditure plan serves to fulfil the goal of the correctional system's transition to a rehabilitative and therapeutic model.

RELATING TO THE HAWAII CORRECTIONAL SYSTEM OVERSIGHT COMMISSION.

Extends the term of the Oversight Coordinator for the Hawaii Correctional System Oversight Commission.  Specifies that the Commission shall take measures as necessary to maintain confidentiality in investigations.  Broadens the Oversight Coordinator's power to make inquiries, obtain information, and inspect the premises of agencies and correctional facilities.

RELATING TO FIREWORKS.

Decriminalizes possession and use of fireworks.  Sets fines for possession and use of fireworks.  Establishes the Fireworks Possession Special Fund and allocates proceeds of the fund to county police departments and for climate change mitigation.

RELATING TO SEARCH AND RESCUE.

Requires government entities to seek reimbursement for search and rescue expenses for persons who require rescue after ignoring warning signs, leaving a hiking trail to enter a prohibited area, or hiking on a trail closed to the public.
