Subjects to forfeiture any vehicle used in the commission of felony disposal of solid waste or petty misdemeanor disposal of solid waste.  Effective 6/30/3000.  (HD1)

RELATING TO WASTE DISPOSAL FACILITIES.

Prohibits the construction, modification, or expansion of any waste or disposal facility for hazardous waste or solid waste on land that is near or above a significant aquifer as determined by the Department of Health in consultation with the Commission on Water Resource Management.  Effective 6/30/3000.  (HD1)

RELATING TO CLIMATE CHANGE.

Requires the Hawaii Community Development Authority to consider the impacts of climate change, sea level rise, and climate-resilient development in the design and siting of buildings in the Kaka‘ako and Kalaeloa community development districts.  Effective 6/30/3000.  (HD1)

RELATING TO HUNTING GUIDES.

Requires hunting guides who take their clients to hunt on private lands to first obtain written permission from the owner of the private land, or occupier or holder, where appropriate.  Requires hunting guides to provide copies of the written permissions obtained to hunt on private lands as part of their annual reports to the Department of Land and Natural Resources.  Effective 6/30/3000.  (HD1)

RELATING TO THE DISPOSITION OF WATER RIGHTS.

RELATING TO DOGS.

RELATING TO THE UNIFORM PARENTAGE ACT.

Requires the department of the attorney general to convene a task force to recommend amendments to update existing parentage laws that reflect cisheteronormative concepts of families, parenthood, and parental rights.  Requires an interim report to the legislature twenty days prior to the regular session of 2024 and a final report forty days prior to the regular session of 2025.  Effective 7/1/3000.  (HD1)

RELATING TO TRANSPORTATION.

Specifies that a certificate of inspection shall be issued if a vehicle is not equipped with a noisy muffler or exhaust system.  Requires rules regarding safety check inspections to ensure that a motorcycle, moped, or motor vehicle is not equipped with a noisy muffler or exhaust system.  Suspends, revokes, or refuses renewal of a permit for an official inspection station upon a third or subsequent wilful violation of any rule regarding inspecting a noisy muffler or exhaust system.  Makes violating the noisy muffler laws a petty misdemeanor.  Includes repairing or installing a noisy muffler or exhaust system as a prohibited practice for motor vehicle repair regulations.  Effective 7/1/2050.  (SD2)

RELATING TO EXPUNGEMENT.

Requires the judiciary and examiner of drivers to no longer include dismissed traffic citations on a person's record, including the traffic abstract and the judiciary's publicly accessible electronic databases.  Requires the court to automatically seal or remove from the judiciary's publicly accessible database any information relevant to the arrest or case of a person for whom an expungement order listing the court case number has been entered and transmitted to the court.  Effective 7/1/2025.  (HD1)

RELATING TO LIMITATIONS OF ACTIONS.

Clarifies that no statute of repose shall affect a condominium association's right of action against a condominium developer sooner than two years after the period of developer control terminates.

RELATING TO RIGHT OF ENTRY FOR PROFESSIONAL SURVEYORS.

Authorizes professional land surveyors, and any assistant under the direct supervision of the professional land surveyor, to enter any private property to perform land surveying, subject to certain provisions regarding objections, notice, and identification.  Shields professional land surveyors and their assistants from prosecution under criminal trespass laws when performing their duties.  Effective 6/30/3000.  (HD1)

RELATING TO BOARDS AND COMMISSIONS.

Clarifies that the authorization for board and commission holdover members to continue in office until a successor is nominated and appointed, but not beyond the end of the second regular legislative session following the expiration of the member's term of office, takes precedence over all conflicting statutes concerning holdover members.  Effective 6/30/3000.  (HD1)

RELATING TO WAGES.

Makes general contractors entering into or under contracts in the State for work on buildings, structures, or other private construction works liable for debt incurred by subcontractors for wages due to claimants, including interest owed, for performance of labor in the contract between the general contractor and owner.  Effective 6/30/3000.  (HD1)

Status

RELATING TO EMPLOYMENT EARNINGS.

Requires certain job listings to include an hourly rate or salary range.  Prohibits an employer from discriminating between employees because of any protected category established under state law, by paying wages to employees in an establishment at a rate less than the rate at which the employer pays wages to other employees in the establishment for substantially similar work.  Effective 6/30/3000.  (HD1)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
