RELATING TO ARRANGEMENT OF CANDIDATE NAMES ON BALLOTS. Requires candidate names to be randomized on individual ballots and randomly rotated across precincts. Requires the Office of Elections to inform voters and candidates, by a method suited for the voting system, that the names of candidates may not be in alphabetical order. Requires that any new contract entered into by the Office of Elections for equipment or services relating to preparing ballots or counting votes include the capability to randomize the names of candidates appearing on the ballot if technologically possible.

RELATING TO CAMPAIGN FINANCE. Increases the amount of fines that may be assessed against a noncandidate committee for violations of organizational report requirements. Increases the amount of fines that may be assessed against noncandidate committees for violations of advertisement disclosure requirements. Increases the fines for advertisements paid by noncandidate committees making only independent expenditures. (SD1)

RELATING TO ELECTIONS. Requires presidential electors to take a pledge that they will vote for their party's nominee. Invalidates the vote of any faithless elector. Removes any faithless elector from the position of elector. Provides procedures for the replacement of electors. Updates rules for certification of electors and their votes to be in full compliance with federal law. (SD1)

RELATING TO DISCLOSURES OF FINANCIAL INTERESTS. Establishes that certain candidates shall file disclosures of financial interests no later than ten days after the nomination filing deadline. Establishes that the unauthorized release of confidential financial disclosure information is subject to chapter 84, Hawaii Revised Statutes. Amends the fines imposed and procedures relating to disclosures of financial interests. (SD1)

RELATING TO VIOLATIONS OF CAMPAIGN FINANCE LAW. Increases the amount of fine from $1,000 to $5,000 that may be assessed against a noncandidate committee making only independent expenditures that has received at least one contribution of more than $10,000, or spent more than $10,000 in an election period, for campaign spending law violations. Allows the Campaign Spending Commission to order the fine be up to three times the amount of the unlawful contribution or expenditure, and to order that the payment of the fine assessed against a noncandidate committee, or any portion thereof, be paid from the noncandidate committee or if the noncandidate committee cannot pay, the personal funds of the candidate or officers of the noncandidate committee. PROPOSING AN AMENDMENT TO ARTICLE II OF THE CONSTITUTION OF THE STATE OF HAWAII. Proposes an amendment to the Hawaii State Constitution to allow the Legislature to enact laws establishing limitations on moneys expended by any noncandidate committee making only independent expenditures to influence the outcome of a state election. RELATING TO ELECTIONS. Requires the Office of Elections to prepare a digital voter information guide; post the guide on its website in compliance with certain accessibility standards; and mail each ballot with a notice that states a voter information guide may be found on its website. Requires the Attorney General and county corporation counsels to translate explanations of ballot questions into certain languages for purposes of the digital voter information guide. Appropriates funds. Effective 7/1/2050. (SD2)

RELATING TO CAMPAIGN FINANCE. Prohibits foreign nationals, foreign-influenced business entities, and foreign corporations from making contributions, independent expenditures, or electioneering communications, or contributions or donations to third parties that are earmarked for such purposes. Requires every business entity that contributes or expends funds in a state election to file a statement of certification regarding its limited foreign influence. Requires noncandidate committees making only independent expenditures to obtain a statement of certification from each top contributor required to be listed in an advertisement. Takes effect 1/1/2026. (SD1)

RELATING TO VOTING MORE THAN ONCE DURING AN ELECTION. Specifies that Hawaii voters are prohibited from casting more than one ballot during an election, even if one of those ballots is cast in an election outside of Hawaii.

RELATING TO PUBLIC FINANCING FOR CANDIDATES TO ELECTED OFFICE. Establishes a comprehensive system of public financing for all candidates seeking election to state and county public offices in the State of Hawaii, to begin with the 2026 general election year. Requires the Campaign Spending Commission to submit a progress and final report to the Legislature. Appropriates funds. Takes effect 03/22/2075. (SD2)

RELATING TO CAMPAIGN FINANCE. Allows candidates seeking election to use campaign funds for child care and vital household dependent care costs under certain conditions.

RELATING TO BOARDS OF REGISTRATION. Requires members of each board of registration be a registered voter in the respective county of the board to which the member is appointed and remain a registered voter in that county for their term of office. Establishes methods for determining and verifying a board member's political party membership. Takes effect 1/1/2024. (SD1)

RELATING TO CAST BALLOTS. Guarantees the vote of eligible voters who cast their ballot and then subsequently die or otherwise become ineligible before election day.

RELATING TO CONTRIBUTIONS BY STATE AND COUNTY CONTRACTORS AND GRANTEES OF THE STATE. Extends the ban on campaign contributions from state and county contractors to grantees of the State under chapter 42F, Hawaii Revised Statutes, and to the owners, officers, and immediate family of the government contractor or state grantee. DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
