RELATING TO HAWAIIAN AS AN OFFICIAL LANGUAGE OF THE STATE OF HAWAII.

Requires that the Hawaiian version of a law be held binding if the law in question was originally drafted in Hawaiian and then translated into English.

RELATING TO THE HAWAIIAN HOMES COMMISSION ACT.

Requires the Department of Hawaiian Home Lands to provide to beneficiaries of the Hawaiian Homes Commission Act, 1920, monthly accountability reports that contain certain information on leases and fiscal matters.  Effective 7/1/2050.  (SD2)

RELATING TO COMPLIANCE ON HAWAIIAN HOME LANDS.

Appropriates funds to the Department of Law Enforcement to hire law enforcement officers dedicated to investigating complaints, conducting investigations, and cooperating with enforcement authorities to ensure compliance with state laws and rules, county ordinances, including the Hawaiian Homes Commission Act, 1920, as amended, and the rules adopted thereunder, on Hawaiian home lands; provided that the law enforcement officers hired for this purpose shall not be prohibited from exercising their law enforcement authority outside of the Hawaiian home lands.  Takes effect 03/22/2075.  (SD2)

RELATING TO THE DEPARTMENT OF HAWAIIAN HOME LANDS.

Authorizes the Department of Hawaiian Home Lands to administer a lease award program for beneficiaries on the homestead lease waiting list who are sixty years old or older or terminally ill, under certain conditions.  Authorizes qualified successors of beneficiaries on the waiting list who died before receiving a lease to file a claim for a lease award within four years of the effective date.  Requires the Department of Hawaiian Home Lands to adopt rules by a certain date.  Effective 3/22/2075.  (SD2)

Reduces the requisite state of mind for the criminal offense of desecration from "intentionally" to "knowingly".  Simplifies the definition of "desecrate".

RELATING TO THE HAWAIIAN HOMES COMMISSION ACT.

Excludes from any waiting list maintained by the Department of Hawaiian Home Lands any lessee or successor who sells or transfers their lease on a tract of Hawaiian home lands for personal gain.  Establishes that the Hawaiian Homes Commission shall have a right of first refusal for the sale or transfer of a lessee's interest in the lease when the sale or transfer is for personal gain.  Takes effect 3/22/2075.  (SD2)

RELATING TO INDEPENDENT LEGAL COUNSEL.

Allows the Department of Hawaiian Home Lands to retain independent legal counsel where the opposing party to the reasonably anticipated litigation is the State or another state agency.  Provides that fees owed to independent legal counsel shall be paid by the State.  Effective 3/22/2075.  (SD2)

RELATING TO NATIVE HAWAIIAN AFFAIRS.

Appropriates funds for certain departments to provide grants to tax-exempt nonprofit organizations that have experience and expertise in supporting and advancing Native Hawaiian communities.  Amends Act 195, Session Laws of Hawaii 2022, to include additional grant requirements.  Effective 7/1/2050.  (SD2)

PROPOSING AN AMENDMENT TO THE HAWAII STATE CONSTITUTION REGARDING THE FREEDOM OF SPEECH.

Proposes an amendment to the Hawaii State Constitution to provide that freedom of speech protected under the Hawaii State Constitution does not include the expenditure of money to influence elections.  Effective 7/1/2050.  (SD2)

RELATING TO JUDGES FOR THE DISTRICT COURT OF THE FIRST CIRCUIT.

Establishes 1 additional district court judgeship in the First Circuit.  Effective 7/1/2050.  (SD1)

PROPOSING AMENDMENTS TO THE CONSTITUTION OF THE STATE OF HAWAII TO AMEND THE MANNER IN WHICH JUSTICES AND JUDGES ARE APPOINTED, CONSENTED TO, AND RETAINED.

Proposes amendments to the Constitution of the State of Hawaii relating to the appointment of justices and judges.  Changes from 30 to 45 days certain time periods for the appointment and consent to a justice or judge.  Harmonizes the Senate consent procedures for district court judgeship nominees to mirror the Senate consent procedures for Supreme Court justices and Intermediate Court of Appeals and circuit court judges.  (SD2)

Status

PROPOSING AMENDMENTS TO ARTICLE VII, SECTIONS 12 AND 13, OF THE HAWAII CONSTITUTION TO EXPRESSLY PROVIDE THAT THE LEGISLATURE MAY AUTHORIZE THE COUNTIES TO ISSUE TAX INCREMENT BONDS AND TO EXCLUDE TAX INCREMENT BONDS FROM DETERMINATIONS OF THE FUNDED DEBT OF THE COUNTIES.

Proposes amendments to the Constitution of the State of Hawaii to expressly provide that the Legislature may authorize political subdivisions, such as counties, to issue tax increment bonds and to exclude tax increment bonds in calculating the debt limit of the political subdivisions.  (SD2)

RELATING TO JURORS.

Clarifies that a prospective juror is disqualified to serve as a juror if they have been convicted of a felony and have not been finally discharged, in addition to not being pardoned.  Takes effect 1/1/2024.  (SD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
