Authorizes the department of land and natural resources to issue special activity permits for the purpose of recognizing and protecting individuals exercising their Native Hawaiian traditional and customary rights.  Effective 6/30/3000.  (HD1)

RELATING TO AQUATIC RESOURCES.

Expands the department of land and natural resources' rulemaking authority to include any rule deemed necessary to protect certain aquatic life.  Expands the board of land and natural resources' authority to temporarily adopt, amend, or repeal certain natural resource rules by formal action at a publicly noticed meeting if the board finds that such adoption, amendment, or repeal is necessary to implement effective and adaptive management measures in response to new or previously benign aquatic nuisance species, in light of newly available technology, or in light of newly available data.  Creates new fines for violations of rules pertaining to the department's prevention of or response to previously benign aquatic nuisance species.  Effective 6/30/3000.  (HD1)

RELATING TO DOMESTIC ABUSE PROTECTIVE ORDERS.

Amends the automatic referral requirements to apply when there are allegations of child abuse and a domestic abuse restraining order is sought.  (HD1)

RELATING TO NOISE POLLUTION.

Establishes noise generated by helicopters in excess of a certain decibel level as a public nuisance and a source of noise pollution in violation of the State's noise pollution law.  Establishes fines and a private right of action for individuals to sue helicopter owners and operators for creating a public nuisance.  Effective 6/30/3000.  (HD1)

Authorizes certain criminal offenders to be ordered by a court to undergo an assessment and then complete either anger management counseling or domestic violence intervention as part of their sentence.  Effective 7/30/3000.  (HD1)

Repeals the requirement for additional rules by the department of agriculture to address nuisance issues, including smell, noise, and excessive lighting arising out of the activities of hemp growers.  Effective 6/30/3000.  (HD1)

RELATING TO DECLARATION OF WATER SHORTAGE AND EMERGENCY.

Amends the conditions, manner, and areas in which the Commission on Water Resource Management of the Department of Land and Natural Resources can declare water shortages and emergencies.  Effective 6/30/3000.  (HD1)

Status

RELATING TO RIGHT OF ENTRY FOR PROFESSIONAL SURVEYORS.

Authorizes professional land surveyors and assistants under the direct supervision of land surveyors to enter private property to perform land surveying, subject to certain provisions regarding notice, identification, and liability.  Shields land surveyors and their assistants from prosecution under criminal trespass laws when performing their duties.  (HD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
