RELATING TO CONTROLLED SUBSTANCES. Prohibits the sale and distribution of hemp products that contain cannabinoids created through isomerization, including Delta 6 cis or trans tetrahydrocannabinol, and their optical isomers (other names: Delta 8 cis or trans tetrahydrocannabinol, and their optical isomers). Exempts certain cannabis and manufactured cannabis product sales from the prohibition. Inserts alternative names for Delta 6 cis or trans tetrahydrocannabinol, and their optical isomers into the list of schedule I controlled substances. Effective 6/30/3000. (HB70 HD1)

RELATING TO ASSISTED COMMUNITY TREATMENT ORDERS. Extends the time period that a family court may order continued assisted community treatment. Reduces the time period that a family court needs to determine whether assisted community treatment should continue. Effective 6/30/3000. (HD1)

RELATING TO GUARDIANSHIP. Part I: Amends the uniform probate code to allow courts to appoint emergency guardians for respondents who reside in psychiatric facilities, hospitals, and homeless shelters. Extends the appointment period. Clarifies that guardians may consent to care, treatment, or service over the objection of wards. Sunsets 1/1/2028. Part II: Requires certain patients subject to emergency hospitalization to be assessed to determine whether a surrogate or guardian is needed to make appropriate health care decisions for the patient. Effective 6/30/3000. (HD1)

RELATING TO HEALTH. Part I: Authorizes the provision of long-acting psychotropic medication to patients who are subject to emergency examination or hospitalization. Authorizes a psychiatric facility or hospital where a patient is held to request the director of health to file a petition for an order for treatment over the patient's objection. Requires the director of health to review the request expeditiously and pursue a petition or convene an administrative panel. Expands who may join in such petition under certain circumstances. Expands the administration of treatment over a patient's objection to include persons in the custody of the director of health at any hospital, or subject to a court order regarding fitness to proceed, an application for involuntary hospitalization, or an emergency examination. Sunsets 7/1/2026. Part II: Authorizes psychiatrists or advanced practice registered nurses, after examination of a person for ACT indication, to request the director of health to file an ACT petition and interested parties to request the director to file an ACT petition on behalf of the interested party. Requires the family court to file final orders on ACT petitions within thirty days. Authorizes the family court to use online hearings for ACT petitions. Authorizes the subject of a petition to stipulate to the proposed order and the family court to enter the stipulated order without an evidentiary hearing. Requires DOH to report to the legislature. RELATING TO HEALTH. Requires the department of health to prioritize complaint allegations based on severity for inspections of state-licensed or state-certified care facilities. Clarifies who is prohibited from knowingly referring or transferring patients to an uncertified or unlicensed care facility. Repeals the landlord exclusion. Effective 6/30/3000. (HD1)

RELATING TO DISABILITY AWARENESS. Designates the month of October as "Disability Awareness Month: Employment, Enrichment, and Inclusion" in recognition of the employment challenges and successes of persons with disabilities in the State. Effective 6/30/3000. (HD1)

RELATING TO THE TRAFFIC CODE. Allows operators of bicycles, motorcycles, and mopeds to proceed through an intersection on a steady red signal during certain hours if the traffic signal is controlled by a vehicle detection device that is inoperative due to the size or composition of the bicycle, motorcycle, or moped. RELATING TO THE WAGE AND HOUR LAW. Amends the definition of "employee" in Hawaii's wage and hour law by realigning the guaranteed compensation of $2,000 or more to a sum that is at least equal to the monthly earnings of an individual who is compensated at the minimum wage rate pursuant to section 387-2, Hawaii Revised Statutes. RELATING TO PESTICIDES. Increases administrative and criminal penalties for violators of the Hawaii pesticides law. Effective 6/30/3000. (HD1)

RELATING TO LABELING OF MACADAMIA NUTS. Clarifies labeling requirements for macadamia nuts. Requires country of origin to be included on the label of a consumer package of raw or processed macadamia nuts. Allows a private right of action for violations. Effective 6/30/3000. (HD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
