RELATING TO GOVERNMENT FRAUD. Adds a new section to chapter 708, Hawaii Revised Statutes, to establish the class C felony offense of government fraud.

RELATING TO OFFICIAL MISCONDUCT. Adds a new section to chapter 710, Hawaii Revised Statutes, to establish the class C felony offense of official misconduct.

RELATING TO TIME LIMITATIONS. Defines the terms "public officer or employee" and "government" in section 701-108, Hawaii Revised Statutes, to clarify the scope and applicability of provisions related to the time limitations to bring prosecution based on misconduct in office.

RELATING TO POLICING. Requires each county police department to collect, report, and publicly publish certain data regarding police stops, arrests, uses of force, and trends. Effective 12/1/23.

RELATING TO TEMPORARY RESTRAINING ORDERS. Allows petitioners to attend TRO hearings remotely when domestic violence or intimate partner violence is alleged or the petitioner has been diagnosed with post-traumatic stress disorder.

RELATING TO FENTANYL TEST STRIPS. Excludes fentanyl test strips from the definition of drug paraphernalia in the controlled substances act.

RELATING TO POLICE REPORTS. Allows surviving immediate family members of deceased persons for whom law enforcement initiated an investigation to receive a copy of the closing report prepared by the investigating police department after a specified period of time.

RELATING TO FORFEITURE PURSUANT TO SECTION 804-51, HAWAII REVISED STATUTES. Allows notice of a bond or recognizance forfeiture to be sent to either the surety (bond company) or surety insurer (insurance company), by certified mail, to start the thirty-day forfeiture countdown for the surety or surety insurer to locate and surrender a principal (criminal defendant) or file a motion or application to set aside the bond or recognizance forfeiture. Provides the State with an avenue to appeal when the court grants a motion or application to set aside a bail bond forfeiture.

RELATING TO PROTECTIVE ORDERS. Allows nonresidents to apply for a temporary restraining order or order for protection in cases of domestic abuse. Allows nonresidents to apply for a temporary restraining order and an injunction from further harassment.

RELATING TO CHILD ABUSE REPORTING. Establishes that the exemption from mandatory reporting by members of the clergy does not apply when the clergy member believes that there exists a substantial risk that child abuse or neglect that is especially heinous, atrocious, or cruel, manifesting exceptional depravity, may occur in the reasonably foreseeable future. Effective 6/30/3000. (HD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
