RELATING TO MOTOR VEHICLE SAFETY INSPECTIONS.

Requires the department of transportation to amend its administrative rules to repeal any provisions requiring the furnishing of evidence of registration as a condition precedent to receiving a certificate of inspection.  Effective 6/30/3000.  (HD1)

RELATING TO SPECIAL MANAGEMENT AREAS.

Expands exclusions from the definition of "development" as it applies to special management areas to reduce the need for special management area permits for certain activities.  Effective 6/30/3000.  (HD1)

RELATING TO MINORS.

Grants a circuit court, when sentencing a minor for a criminal offense, the discretion to impose a sentence that includes a period of incarceration that is as much as fifty per cent shorter than any mandatory minimum and, in certain cases, decline to impose a mandatory enhanced sentence.

RELATING TO CHILDREN.

Requires that when an officer has custody of a child under the age of eighteen for an alleged violation of law, the child shall have contact with legal counsel and, to the extent practicable, a parent or legal guardian before the child waives any constitutional rights and before any custodial interrogation.  Effective 6/30/3000.  (HD1)

RELATING TO FAMILY.

Establishes an exemption from mediation in paternity proceedings where there are allegations of domestic abuse if the party alleging domestic abuse does not wish to participate.  Prohibits a mediator from engaging in mediation where there are allegations of domestic abuse unless certain requisites are met.  Prohibits a court from requiring mediation in paternity proceedings if there is a temporary restraining order or a protective order in effect and the party alleging domestic abuse does not wish to participate.  Allows the court to order mediation in paternity proceedings where there are allegations of domestic abuse but there is no temporary restraining order or no protective order, under certain circumstances.  Replaces the term "family violence" with "domestic abuse" in section 580‑41.5, HRS.

RELATING TO EDUCATION.

Requires a minor student's parent or legal guardian, rather than the student, to produce the required student records when transferring schools.  Clarifies that emancipated minors may produce the required student records when transferring schools.  Clarifies that the transfer process is the same whether a transfer is within the same complex area or to another complex area.  Exempts students eligible for assistance provided under the federal McKinney-Vento Homeless Assistance Act of 1987 from producing required student records when transferring schools.  Effective 6/30/3000.  (HD1)

Status

RELATING TO INTERIM ADMINISTRATIVE RULES OF THE DEPARTMENT OF HAWAIIAN HOME LANDS.

Allows the Department of Hawaiian Home Lands to issue interim rules that shall be exempt from the public notice, public hearing, and gubernatorial approval requirements of chapter 91, Hawaii Revised Statutes, after beneficiary consultation is conducted by the Department of Hawaiian Home Lands and upon approval by the Hawaiian Homes Commission.  The interim rules shall be effective for not more than eighteen months.

RELATING TO PROCUREMENT.

Allows bidders to clarify or correct immaterial or technical information required as part of a bid submission for up to twenty-four hours after the bid submission deadline, in addition to the time for correction or withdrawal of inadvertently erroneous bids before or after the award as permitted by rules adopted by the procurement policy board.  Requires that bids for construction be opened no sooner than twenty-four hours after the deadline for the submission of bids.  Defines "immaterial or technical information".  Repeals 6/30/2028.  Effective 6/30/3000.  (HD1)

Status

RELATING TO ADMINISTRATIVE RULEMAKING.

Requires that prior to the adoption, amendment, or repeal of an administrative rule, electronic notice of the proposed rulemaking be provided to all persons who have made a timely written request to, and provided a valid working email address to, the adopting agency for advance notice of its rulemaking proceedings.  Requires that alterations to administrative rules be displayed in Ramseyer format and the full text of rules be made available in a digitally accessible and searchable format.  Effective 6/30/3000.  (HD1)

Status

RELATING TO THE COMMUNITY COURT OUTREACH PROJECT.

Makes the community court outreach project permanent.  Amends the project to address homeless defendants and expand the opportunities for eligible defendants to participate.  Appropriates funds for additional personnel and enhanced security services.  Effective 6/30/3000.  (HD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
