RELATING TO SUPPORT FOR TRADITIONAL NATIVE SPEAKERS OF HAWAIIAN.

Requires that, in any island with a population of five hundred or less, every effort shall be made to accommodate Hawaiian speakers and readers and defines the term Hawaiian language for that purpose.  Authorizes department of education schools in any island with a population of five hundred or less to offer Hawaiian language as the sole indigenous language of the Hawaiian islands.  Appropriates funds to the state public charter school commission to study the Hawaiian language and for the publication of educational resource materials for native speakers of the Hawaiian language.  Effective 6/30/3000.  (HD1)

Reflects the migration of the office of homeland security from the department of defense to the department of law enforcement on 1/1/2024.  Effective 6/30/3000.  (HD1)

RELATING TO PUBLIC LANDS.

Authorizes the designation of areas or regions of public lands classified as commercial and industrial; hotel, apartment, and motel; or resort, and the establishment and implementation of guidelines for the redevelopment of the areas or regions that will:  (1) modernize the policies for the management of public lands in the designated area; (2) establish a plan for the designated area, including district-wide improvements, that is coordinated with state and county land use and planning policies; and (3) implement asset and property management concepts that can optimize income from the properties and evolve in response to changing principles of property administration.  Designates the public lands on the Waiakea peninsula on the island of Hawaii as the Waiakea peninsula redevelopment district.  Appropriates funds.  Effective 6/30/3000.  (HD1)

RELATING TO ENVIRONMENTAL CRIMES.

Establishes the Environmental Crimes Unit within the Department of the Attorney General.  Makes the disposal of motor vehicle tires in violation of State law governing recovery of used motor vehicle tire recovery a petty misdemeanor.  Establishes a $1 motor vehicle tire surcharge to be imposed on every replacement tire installed on a motor vehicle in the State after 9/30/2023.  Requires tire retailers and tire wholesalers who install replacement tires to pay the surcharge to the Department of Health.  Requires the Department of Health to deposit the revenues into the Environmental Management Special Fund.  Allows the Department of Health to use the Environmental Management Special Fund to fund the Environmental Crimes Unit.  Appropriates funds.  Effective 6/30/3000.  (HD1)

RELATING TO PUBLIC SAFETY.

Requires and appropriates moneys for the provision of free voice communication services in the State's youth and adult correctional facilities.  Prohibits state agencies from deriving revenue or financial benefits from the provision of communication services to persons confined in state correctional facilities.  Appropriates funds for the Hawaii state automated victim information and notification program.  (HD1)

RELATING TO AGRICULTURE.

Clarifies that "customary and traditional subsistence farming", which is customary and traditional subsistence farming conducted by a Native Hawaiian cultural practitioner in certain situations, is included as a protected activity under the Hawaii right to farm act.  Clarifies that the cultivation of crops and activities related to game, fish, and livestock in the agricultural district may be for economic use or customary and traditional subsistence farming.  Provides that one of the State's policies under the Hawaii State Planning Act's agricultural objectives is to assure the right of customary and traditional subsistence farming.  Effective 7/1/3000.  (HD1)

RELATING TO FUNDING FOR THE DEPARTMENT OF THE ATTORNEY GENERAL TOBACCO ENFORCEMENT UNIT.

Amends the amount of funding for the tobacco enforcement special fund within the department of the attorney general by:  amending the amount of funds that the tobacco enforcement special fund can carry over at the end of the fiscal year; increasing the cigarette tax stamp fee and concurrently increasing the percentage of the cigarette tax stamp fee deposited to the tobacco enforcement special fund; and amending the amount of funds to be deposited in the tobacco enforcement special fund from the Hawaii tobacco settlement special fund.  Effective 6/30/3000.  (HD1)

RELATING TO REHABILITATION.

Expands the criminal justice diversion program.  Amends the allowable period of court-ordered assisted community treatment and considerations for extensions.  Allows courts to require certain probation violators to undergo mental health evaluation and treatment as a condition of continued probation.  Requires DOH to contract with behavioral health crisis centers.  Appropriates funds.  Effective 7/1/3023.  (HD1)

RELATING TO AMERICAN SIGN LANGUAGE.

Recognizes American Sign Language as a fully developed, autonomous, natural language with its own grammar, syntax, vocabulary, and cultural heritage.  Effective 6/30/3000.  (HD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
