RELATING TO HISTORIC PRESERVATION REVIEWS.

Authorizes the department of land and natural resources, through the state historic preservation division and subject to approval from the appropriate island burial council, to contract its review of proposed state projects, projects on privately owned historic property, and projects affecting historic properties to third-party consultants if the department will not be able to complete its review within sixty days.  Appropriates funds.  Effective 6/30/3000.  (HD1)

RELATING TO THE CONSERVATION AND RESOURCES ENFORCEMENT PROGRAM.

Requires the department of land and natural resources to establish an unmanned aircraft systems program.  Authorizes conservation and resources enforcement officers to use unmanned aircraft systems.  Requires the department of land and natural resources to submit a biennial report of the effectiveness of the unmanned aircraft systems program to the legislature.  Appropriates funds.  Effective 6/30/3000.  (HD1)

RELATING TO HOUSING.

Conditions the authority of a county whose population is greater than five hundred thousand to exercise state housing powers upon a county's continued compliance with provisions regarding acceptance of the dedication of infrastructure and public highways in affordable housing developments.  Amends various provisions relating to the dedication of infrastructure to a county.  Effective 7/1/3000.  (HD1)

RELATING TO FLOODING.

Appropriates moneys as grants-in-aid to the several counties for the mitigation of flood risks on privately-owned roads.  Provides that the appropriation or expenditure of moneys pursuant to the Act shall not be construed to establish a duty of care or grounds for liability for the State or the several counties.  Effective 7/1/3000.  (HD1)

Authorizes the counties to use the county surcharge on GET revenues and fuel tax revenues for the repair and maintenance of private roadways that are open to the public.  Effective 7/1/3000.  (HD1)

RELATING TO THE COMMUNITY COURT OUTREACH PROJECT.

Makes the community court outreach project permanent.  Amends the project to address homeless defendants and expand the opportunities for eligible defendants to participate.  Appropriates funds for additional personnel and enhanced security services.  Effective 6/30/3000.  (HD1)

RELATING TO MOTOR VEHICLE INSURANCE.

Increases, in tiers, the minimum amounts of liability insurance coverage required under motor vehicle insurance policies.  Requires the insurance commissioner to solicit rate filings for the changes in the minimum amounts.  Applies to policies entered into, amended, or renewed on or after the effective date of the Act.  Effective 6/30/3000.  (HD1)

RELATING TO ELECTRONIC SMOKING DEVICES.

Establishes a tax equal based on the manufacturer's list price for electronic smoking devices and e-liquid products.  Expands the electronic smoking device retailer registration unit to include wholesalers and e-liquid products retailers and wholesalers.  Requires electronic cigarette and e-liquid products retailers and wholesalers to register with the electronic smoking device and e-liquid products retailer and wholesaler registration unit.  Effective 1/1/3000.  (HD1)

RELATING TO CRIMINAL HISTORY BACKGROUND CHECKS.

Authorizes a fingerprint-based criminal history background check by the county police departments of applicants for licenses to sell, offer to sell, distribute, or otherwise transfer electric guns or cartridges.

Adds the requirement of notifying the Terrorist Screening Center administered by the Federal Bureau of Investigation as part of the gun permit application background check process.

RELATING TO FIREARMS.

Establishes standards of conduct for firearm industry members. Authorizes any person who has suffered harm because of a firearm industry member's violation of the standards of conduct to bring a civil action. Authorizes the attorney general or any county attorney or public prosecutor to bring a civil action against a firearm industry member for violation of standards of conduct.

RELATING TO FIREARMS.

Amends, clarifies, and enacts provisions of chapter 134, Hawaii Revised Statutes (HRS); amends section 707-716, HRS; and amends and clarifies section 846-2.7(b), HRS.  Amends and enacts requirements and processes regarding permits to acquire and licenses to carry a firearm; updates criteria governing when firearm ownership, possession, or control is prohibited; identifies locations within the State where carrying or possessing firearms is prohibited; requires a person carrying a firearm pursuant to a license to have in the person's immediate possession the license and documentary evidence that the firearm being carried is registered; requires a person carrying a firearm in public pursuant to a license to maintain insurance coverage; requires that when a person carrying a firearm is stopped by a law enforcement officer or is a driver or passenger in a vehicle stopped by a law enforcement officer, the person shall immediately disclose to the law enforcement officer that the person is carrying a firearm and, upon request, identify the specific location of the firearm and present to the law enforcement officer a license or credentials to carry a firearm; prohibits leaving an unsecured firearm in a vehicle unattended; prohibits consuming or being under the influence of alcohol or intoxicating liquor or a controlled substance while carrying a firearm; prohibits carrying a firearm on private property open to the public without express authorization; and amends, clarifies, and enacts other provisions relating to firearms.  Provides that criminal history record checks may be conducted by county police departments on applicants for licenses to carry a pistol or revolver and ammunition pursuant to section 134-9, HRS.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
