MAKING APPROPRIATIONS FOR CLAIMS AGAINST THE STATE, ITS OFFICERS, OR ITS EMPLOYEES. Makes appropriations and approves payments for claims against the State, its officers, and its employees.

PROPOSING AMENDMENTS TO ARTICLE VII, SECTIONS 12 AND 13, OF THE HAWAII CONSTITUTION TO EXPRESSLY PROVIDE THAT THE LEGISLATURE MAY AUTHORIZE THE COUNTIES TO ISSUE TAX INCREMENT BONDS AND TO EXCLUDE TAX INCREMENT BONDS FROM DETERMINATIONS OF THE FUNDED DEBT OF THE COUNTIES. Proposes amendments to the Constitution of the State of Hawaii to expressly provide that the legislature may authorize political subdivisions, such as counties, to issue tax increment bonds and to exclude tax increment bonds in calculating the debt limit of the political subdivisions.

RELATING TO HOMELAND SECURITY. Establishes a Targeted Violence Prevention program within the state Office of Homeland Security. Mandates reporting by state and county government agencies regarding specific enumerated activity. Establishes the all-threats or all-hazards statewide reporting and analysis system. Mandates reporting by state and county government agencies regarding specific enumerated activity. Creates two new analyst position and appropriates money for the program.

RELATING TO ACT 278, SESSION LAWS OF HAWAII 2022. Amends Act 278, Session Laws of Hawaii 2022, to modify the transfer of the personnel and functions of the Department of the Attorney General to the Department of Law Enforcement, clarify that Act 278 does not amend or abrogate the Attorney General's status as the Chief Legal and Law Enforcement Officer of the State, specify that the Statewide Law enforcement Training Complex will be located at the First Responder Technology Campus rather than the Mililani Technology Park, and transfer the responsibility and management of certain private security contracts under section 26-14.6, Hawaii Revised Statutes, from the Department of Law Enforcement to the Department of Defense, the Department of Health, and the Department of Human Services for their respective facilities.

RELATING TO THE DRUG AND ALCOHOL TOXICOLOGY TESTING LABORATORY. Makes an appropriation for the Department of Transportation Highways Division to deposit state highway funds to the drug and alcohol toxicology testing laboratory special fund in fiscal year 2023-2024 and fiscal year 2024-2025; authorizes the Department of Health and/or appropriate a grant-in-aid to the City and County of Honolulu Emergency Services Department to expend funds from the drug and alcohol toxicology testing laboratory special fund in fiscal year 2023-2024 and fiscal year 2024-2025; amends references to the state drug and alcohol toxicology testing laboratory special fund.

RELATING TO ADDRESS CONFIDENTIALITY. Changes the governmental entity responsible for the administration of the address confidentiality program from the office of the lieutenant governor to the department of the law enforcement beginning 1/1/2024. Authorizes the department of law enforcement to contract the services of a third party to administer the program. Appropriates funds for full-time equivalent positions, operating costs, and equipment to support the department of law enforcement's criminal justice data center in administering the address confidentiality program.

RELATING TO MARRIAGE. Provides for the replacement of certificates of marriage for individuals who have changed their gender, sex, and, if applicable, name. Effective 6/30/3000. (HD1)

RELATING TO ADOPTION. Allows an adopted individual to benefit both by relationship through a natural parent and through an adoptive parent in a disposition or other designation as provided for in accordance with the Hawaiian Homes Commission Act, 1920, as amended, or administrative rules. Allows the adopted individual and individual's natural family to continue having the same familial relationship.

RELATING TO COLLECTIVE BARGAINING. Establishes that the representative of labor on the Hawaii labor relations board be a person selected by a majority of the exclusive representatives of the collective bargaining units. Effective 6/30/3000.

RELATING TO PUBLIC WORKS. Imposes penalties, including suspension, on the person and the firm upon a finding of violation of state law governing wages and hours of employees on public work projects. Effective 6/30/3000.

RELATING TO REAL PROPERTY LIENS. Authorizes the State and the county in which the affected real property is situated to place a lien on the property for unpaid civil fines resulting from a violation of a land use law in connection with the property. Authorizes the State and applicable county, subject to adoption of appropriate and particular laws or rules establishing the power of sale, to sell the property after all notices, orders, and appeal proceedings, if any, are exhausted and use those revenues to pay unpaid civil fines related to that property. Effective 6/30/3000. (HD1)

RELATING TO CIVIL TRESPASS. Establishes the civil infraction of trespass onto real property and monetary penalties therefor. Provides that a violator shall be issued a citation. Requires violations to be adjudicated in the district courts using a system similar to that used for adjudicating traffic infractions and emergency period infractions. Requires the Judiciary to have established and implemented no later than 1/1/2024 the system to adjudicate citations for civil trespass.

RELATING TO STATE WATER CODE PENALTIES. Adds a minimum penalty of $50 and a maximum penalty of $25,000 per violation of the state water code and makes each day that a violation exists or continues to exist a separate offense. Requires the commission on water resource management to determine the amount of the penalty based on the circumstances of the violation. Creates two positions within the commission on water resource management. Appropriates funds. Effective 6/30/3000. (HD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
