RELATING TO ELECTIONS.

Requires the office of elections to prepare a voter information guide that includes candidate statements and statements on ballot questions.  Appropriates funds to the department of the attorney general, legislative reference bureau, and counties for the preparation of the ballot analyses.  Appropriates funds to the office of elections for the preparation and distribution of the voter information guides.

Status

RELATING TO PUBLIC RECORDS.

Beginning 7/1/2024, imposes a cap on charges for the reproduction of certain government records; waives the cost of duplication of government records provided to requestors in an electronic format; imposes a cap on charges for searching for, reviewing, and segregating records; and provides for a waiver of fees when the public interest is served by a record's disclosure.  Appropriates funds for positions in the office of information practices.

RELATING TO PARTIAL PUBLIC FINANCING OF ELECTIONS.

Increases the amount of partial public financing available for all offices.  Increases the maximum amount of public funds available for all offices by fifty per cent.  Increases the maximum amount of public funds available for a candidate for OHA from $1,500 to ten per cent of the expenditure limit established by statute for each election.  Increases the amounts of qualifying contributions for OHA from more than $1,500 in the aggregate to more than $5,000 in the aggregate.  Provides a downward adjustment of the minimum amounts of qualifying contributions for the office of prosecuting attorney for the city and county of Honolulu, and counties of Hawaii and Kauai, and for the office of county council for the county of Maui.  Establishes two full-time equivalent (2.0 FTE) positions in the campaign spending commission.  Appropriates funds.

Establishes the office of the public advocate.  Establishes rights for members of the public with respect to the conduct and operation of the legislature and its members.  Specifies procedures for the investigation and reporting of alleged violations of the rights.

PROPOSING AMENDMENTS TO ARTICLE III OF THE CONSTITUTION OF THE STATE OF HAWAII TO ESTABLISH LEGISLATIVE TERM LIMITS.

Proposes a constitutional amendment to prohibit a person from serving as a member of the legislature for more than sixteen years during the person's lifetime.

RELATING TO PARENTAGE.

Enacts portions of the Uniform Parentage Act of 2017 to replace the Uniform Parentage Act of 1973.  Takes effect 1/1/2024.

RELATING TO CHILDREN.

Expands the original jurisdiction of family court to include proceedings for declaration of emancipation of minors.  Specifies the rights of an emancipated minor.  Allows a minor who has reached the age of sixteen years to petition the family court for a declaration of emancipation.  Allows certain parties to petition the family court for voidance or rescission of a declaration of emancipation.  Sets forth court procedures and standards in issuing, voiding, and rescinding a declaration of emancipation.  Allows parties to appeal the court's decisions pertaining to emancipation to the Intermediate Court of Appeals.  Effective 6/30/3000.  (HD1)

RELATING TO CHILD SUPPORT.

Requires the attorney general and department of human services to convene a working group to examine the impacts, costs, and impediments of allowing child support payments to pass through to recipients of Temporary Assistance for Needy Families program funds and submit a joint report to the 2025 legislature.  Effective 6/30/3000.  (HD1)

Status

RELATING TO YOUTH FEES AND FINES.

Prohibits the assessment of any fines, fees, or court costs against a person who was adjudicated for an offense committed while the person was a minor under the age of eighteen, or against the person's parent or guardian.  Limits court ordered community service for minors to seventy-two hours.  Repeals the statewide curfew for minors.  Effective 6/30/3000. (HD1)

RELATING TO THE DEPARTMENT OF HAWAIIAN HOME LANDS.

Exempts any housing development for the department of Hawaiian home lands from general excise tax and school impact fee requirements.  Makes permanent the exemption of housing developed where new housing units are created by the department of Hawaiian home lands from school impact fee requirements.  Lapses the appropriation provided under Act 279, SLH 2022, and appropriates funds for the purposes of Act 279, SLH 2022 for the current fiscal year.  Makes permanent the issuance of county affordable housing credits to the department of Hawaiian home lands.  Effective 7/1/3000.  (HD1)

Status

RELATING TO EQUITY.

Requires all places of public accommodation and state building construction constructed after 12/31/23 to provide universal changing accommodations that are equally accessible to men and women.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
