The Committee will meet to continue the hearing started on Tuesday, February 14, 2023 on the measures listed below. The committee was unable to complete the hearing on Tuesday due to time constraints. Additional testimony will not be accepted.

RELATING TO ADVISORY COMMITTEES. Renames the statewide and county-level voters with special needs advisory committees to elections accessibility needs advisory committees. Recognizes that voting accessibility needs may arise from disabilities other than those of a physical nature.

RELATING TO DISCLOSURES OF FINANCIAL INTERESTS. Establishes that certain candidates shall file disclosures of financial interests no later than 10 days after the nomination filing deadline. Establishes that the unauthorized release of confidential financial disclosure information is subject to chapter 84, Hawaii Revised Statutes. Amends the fines imposed and procedures relating to disclosures of financial interests.

RELATING TO LOBBYING. Amends the definitions of "administrative action" and "lobbying" in Chapter 97, HRS.

RELATING TO VIOLATIONS OF CAMPAIGN FINANCE LAW. Increases the amount of fine from $1,000 to $5,000 that may be assessed against a noncandidate committee making only independent expenditures that has received at least 1 contribution of more than $10,000, or spent more than $10,000 in an election period, for campaign spending law violations. Allows the Campaign Spending Commission to order the fine be up to 3 times the amount of the unlawful contribution or expenditure, and to order that the payment of the fine assessed against a noncandidate committee, or any portion thereof, be paid from the personal funds of an officer of the noncandidate committee.

RELATING TO CRIMINAL PROCEDURE. Adds a new section to Chapter 801, Hawaii Revised Statutes, establishing circumstances in which the presence of a defendant is required for court proceedings or may be waived.

RELATING TO FRAUD. Establishes the offense of fraud as a class B felony. Establishes the offense of making a false, fictitious, or fraudulent claim against the State or a county as a class C felony. Establishes the offense of the use of false statements or entries in matters within the jurisdiction of the executive, legislative, or judicial branches of the State as a class C felony.

RELATING TO CANNABIS. Establishes regulations for the cultivation, sale, and personal use of small amounts of cannabis. Decriminalizes and regulates small amounts of cannabis for personal use. Establishes taxes for cannabis sales.

RELATING TO THE OFFICE OF INFORMATION PRACTICES. Gives the Office of Information Practices the discretion to resolve disputes about open records or open meetings either through an opinion or, when the opinion would likely be in favor of the agency, through informal written guidance. Appropriates funding for the Office of Information Practices to hire two new full-time positions for a Legal Assistant and Attorney.
