Status

RELATING TO FAMILY.

Establishes an exemption from mediation in paternity proceedings where there are allegations of domestic abuse if the party alleging domestic abuse does not wish to participate.  Prohibits a mediator from engaging in mediation where there are allegations of domestic abuse unless certain requisites are met.  Prohibits a court from requiring mediation in paternity proceedings if there is a temporary restraining order or a protective order in effect and the party alleging domestic abuse does not wish to participate.  Allows the court to order mediation in paternity proceedings where there are allegations of domestic abuse but there is no temporary restraining order or no protective order, under certain circumstances.  Replaces the term "family violence" with "domestic abuse" in section 580‑41.5, HRS.

Amends the automatic referral requirements to apply when there are allegations of child abuse and a domestic abuse restraining order is sought.

MAKING AN APPROPRIATION TO IMPLEMENT THE RECOMMENDATIONS OF THE TASK FORCE ON MOBILITY MANAGEMENT, ESTABLISHED PURSUANT TO ACT 214, SESSION LAWS OF HAWAII 2013.

Makes an appropriation to the department of health to implement the recommendations of the statewide mobility management task force, established pursuant to Act 214, Session Laws of Hawaii 2013.  Effective 7/1/3000.  (HD1)

Amends Act 317, Session Laws of Hawaii 2022, to give the department of human services flexibility in developing a comprehensive child welfare information system and extend the appropriation lapse date.  Effective 6/29/23.  (HD1)

RELATING TO MINORS.

Provides that a school counselor, domestic violence victim advocate, or other mental health professional licensed by the State may petition for a protective order on a minor's behalf when the minor's parent or guardian is unwilling or unable to submit a petition; provided that certain specified information is provided in support of the petition.

RELATING TO CHILD PROTECTION.

Establishes definitions of "immediate harm" and "protective custody warrant" for the purpose of the Child Protective Act.  Requires a police officer who assumes protective custody of a child who is subject to immediate harm to provide a written report detailing the observations justifying the immediate removal to the department within twenty-four hours of assuming custody of the child.  Requires a copy of the police report to be provided to the parents of the child and to the court.  Requires the department of human services to provide written notice to a parent of parental rights when conducting an investigation regarding a child who has been harmed or may be subject to imminent or threatened harm.

Requires certain individuals attempting to serve as child custody evaluators to complete a training course on domestic violence issues every 3 years.  Requires the Family Court to approve training courses and publish approved courses on the Judiciary website.

Requires certain individuals attempting to serve as child custody evaluators to complete a training course on the dynamics of domestic violence every three years.  Requires individuals to submit a letter or certificate of completion to the Family Court.

RELATING TO YOUTH.

Establishes a grant program within the Office of Youth Services.  Gives priority to programs that support youth from ethnic groups that are disproportionately represented in the State's correctional system, support rehabilitation, or meet needs identified by the Office of Youth Services in consultation with the community.  Appropriates moneys.

RELATING TO CHILD WELFARE SERVICES.

Establishes the Malama Ohana working group to seek, design, and recommend transformative changes to the State's child welfare system.  Appropriates funds to increase the procurement of contracted services to provide additional support and resources to families receiving benefits from the State's adoption assistance and permanency assistance programs.  Requires the working group to submit a report to the 2025 Legislature.

Status

RELATING TO THE NEIGHBOR ISLANDS BLIND AND VISUALLY IMPAIRED SERVICE PILOT PROGRAM.

Requires the Department of Human Services to establish a neighbor islands Blind and Visually Impaired Service Pilot Program that provides training and other services to blind or visually impaired individuals residing on the neighbor islands.  Requires the Department of Human Services to establish a working group and submit an implementation plan to the Legislature before the Regular Session of 2024.  Requires the Department to report to the Legislature prior to the Regular Session of 2027.  Appropriates funds.

RELATING TO TAX CREDIT FOR ON-SITE EARLY CHILDHOOD FACILITIES.

Establishes an income tax credit for employers who create on-site early childhood facilities. Establishes and appropriates funds for 1.0 FTE on-site early childhood facility coordinator position.  Applies to taxable years beginning after 12/31/2023.  Takes effect on 7/1/2024.

Status

RELATING TO THE SUPPLEMENTAL NUTRITION ASSISTANCE PROGRAM.

Establishes an additional minimum Supplemental Nutrition Assistance Program (SNAP) benefit of $250 per month per person for SNAP-eligible households whose income is below two hundred per cent of the federal poverty level, as established by the United States Department of Agriculture.  Requires that SNAP-eligible households whose monthly income exceeds two hundred per cent of the federal poverty level receive a graduated decline of additional SNAP benefits.  Requires state general funds to be used to supplement the cost of the additional benefits.  Appropriates funds.

RELATING TO HUMAN SERVICES.

Authorizes health care providers, nonprofit organizations, businesses, and faith-based organizations to distribute supplemental nutrition assistance program applications to prospective applicants.

RELATING TO THE SUPPLEMENTAL NUTRITION ASSISTANCE PROGRAM.

Requires the Department of Human Services to establish a state corollary to the federal Supplemental Nutrition Assistance Program for certain higher education students.  Appropriates moneys.

RELATING TO THE SENIOR MEDICARE PATROL PROGRAM.

Appropriates funds for three program specialist positions within the Executive Office on Aging for the State's Senior Medicare Patrol Program.

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
