RELATING TO THE CHILD PROTECTIVE ACT. Requires an independent evaluation of a child's parents before a child is returned to the child's family home, under certain conditions. Clarifies the purpose of the child protective act. Allows certain contact between grandparents and a child in foster care. Provides a child's biological grandparents with certain rights and duties. Amends the definition of "aggravated circumstances". Includes grandparents under the definition of "family". Expands the factors to be considered when providing a child with a safe family home to include evaluations conducted by an independent provider with certain specialized training. Establishes certain requirements for interviewees, documentation, and assessments by DHS. Requires foster placement preference to be given to relatives, if it is in the best interest of the child. Establishes certain requirements for DHS when conducting investigations. Establishes written response requirements for DHS to a complainant after child abuse or neglect investigation. Specifies that a department social worker shall be unbiased and reflect no prejudice in their professional assessments.

RELATING TO CHILD SUPPORT. Requires certain amounts of child support moneys collected by the Department of Human Services for public assistance of a child to pass through to the family receiving public assistance. Requires the Department of Human Services to disregard passed‑through child support payments when calculating the income of an applicant for or recipient of public assistance. Increases the maximum fine for an employer who discharges from employment, refuses to employ, or takes disciplinary action against any noncustodial parent subject to income withholding or who fails to comply with an order of assignment of future income to pay child support. Appropriates funds.

RELATING TO MEDICAID. Requires the department of human services to adopt rules to remove the $2,000-per-individual asset limit for eligibility for assistance under the med-QUEST program. Requires a report to legislature.

ESTABLISHING THE SOCIAL WORKERS FOR PUBLIC SAFETY PILOT PROGRAM. Establishes a 5-year social workers for public safety pilot program in the Department of Public Safety, or its successor agency. Requires social workers to accompany law enforcement officers in responding to incidents where a person may be unsheltered, substance addicted, or mentally impaired. Requires interim reports and a final report to the Legislature. Appropriates moneys for the pilot program, including the establishment of 5.0 FTE public safety social worker positions in the Department of Public Safety, or its successor agency.

RELATING TO BACKGROUND CHECKS. Authorizes the Department of Human Services to conduct national criminal background checks for current and prospective employees; volunteers; contractors; and contractors' employees, agents, and volunteers, who are in positions that require close proximity to certain minors, young adults, or vulnerable adults.

RELATING TO EARLY LEARNING OPPORTUNITIES. Requires the department of human services to establish a child care accreditation program to assist licensed and registered child care providers obtain accreditation. Amends the time period for when existing preschool open doors service providers are required to obtain accreditation. Appropriates funds for the child care accreditation program, including for the establishment of one full-time position for the program. Appropriates funds into the child care grant special fund.

Appropriates moneys for the Preschool Open Doors Program and Executive Office on Early Learning to expand access to preschool and to implement program changes required by previous acts. Expands the types of entities from which a Preschool Open Doors service provider may obtain accreditation. Authorizes the preschool open doors special fund to accept federal funds. Appropriates moneys.

RELATING TO CHILDREN. Requires that when an officer has custody of a child under the age of sixteen for an alleged violation of law, the child shall have contact with legal counsel or a parent or legal guardian before the child waives any constitutional rights and before any custodial interrogation.

RELATING TO CHILD CARE. Requires the department of human services, when determining income eligibility for child care subsidies, to consider special circumstances, such as the retroactive payment of worker's compensation or temporary disability insurance benefits, that cause the monthly gross income of a parent, guardian, or other responsible party to exceed the eligible monthly gross income.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
