RELATING TO HEALTH. Requires certain patients subject to emergency hospitalization to be assessed to determine whether a surrogate or guardian is needed to make appropriate health care decisions for the patient.

RELATING TO GUARDIANSHIP. Amends the Uniform Probate Code to allow courts to appoint emergency guardians for respondents who reside in psychiatric facilities, hospitals, and homeless shelters. Extends the appointment period. Clarifies that guardians may consent to care, treatment, or service over the objection of wards. Sunsets 1/1/2028.

RELATING TO ASSISTED COMMUNITY TREATMENT. Permits interested parties to request the director of health to file an assisted community treatment petition on behalf of the interested party. Requires final orders for a petition to be filed within thirty days of the date an assisted community treatment petition is filed. Permits the family court to use online hearings for assisted community treatment petitions. Permits the subject of a petition to stipulate to the proposed order and for the court to enter the stipulated order without an evidentiary hearing. Requires the department of health to report to the legislature on the number of requests for petitions submitted to the director of health.

RELATING TO HEALTH. Authorizes long-acting psychotropic medication to be provided to patients who are subject to emergency examination or hospitalization. Expands the administration of treatment over a patient's objection to include persons in director of health custody at any hospital, subject to an emergency examination, subject of an application for involuntary hospitalization, and subject to a court order regarding fitness to proceed for a criminal trial. Requires orders for treatment over objection proceedings to be expedited. Expands who may file a petition for an order to treat over objection under certain circumstances. Sunsets 7/1/2026.

RELATING TO THE UNIFORM CONTROLLED SUBSTANCES ACT. Updates the Uniform Controlled Substances Act, chapter 329, Hawaii Revised Statutes, to make it consistent with amendments in the federal controlled substances law as required by section 329-11, Hawaii Revised Statutes.

RELATING TO NOISE POLLUTION. Establishes noise generated by helicopters in excess of a certain decibel level as a public nuisance and a source of noise pollution in violation of the State's noise pollution law. Establishes fines and a private right of action for individuals to sue helicopter owners and operators for creating a public nuisance.

RELATING TO BEHAVIORAL HEALTH CRISIS STABILIZATION BEDS. Appropriates funds to the Adult Mental Health Division of the Department of Health to support increased behavioral health crisis stabilization beds. Creates a working group to get county input on possible sites for these crisis stabilization beds. Effective 7/1/2023.

RELATING TO CESSPOOLS. Creates within the Department of Health's wastewater branch a cesspool conversion section, which will be responsible for facilitating the conversion of cesspools within the State. Establishes and appropriates funds for two full-time equivalent positions within the cesspool conversion section in fiscal years 2023-2024 and 2024-2025, and two additional full-time equivalent positions within the section in fiscal year 2024-2025. Effective 6/30/3000. (HD1)

RELATING TO CESSPOOLS. Establishes an income tax credit for the cost of upgrading or converting a qualified cesspool to a director of health-approved wastewater system or connecting to a sewerage system. Requires certain information regarding cesspools on real property to be included in seller mandatory disclosures on real property transactions. Effective 6/30/3000. (HD1)

RELATING TO CESSPOOLS. Establishes and appropriates funds for a pilot program within the environmental management division of the department of health to work with each county to identify a priority area to expand the county sewage system or other centralized treatment system to connect individual properties in the priority area and reduce or eliminate cesspools in the identified area. RELATING TO CONTROLLED SUBSTANCES. Requires the registration and registration renewal for methadone clinics and substance use disorder services clinics to be deemed a clinic and for the handling of controlled substances to be contingent upon its location being at least 750 feet away from a school. Gives methadone clinics and substance use disorder services clinics one year from the effective date of this Act to comply with this Act.

RELATING TO EARLY INTERVENTION SERVICES. Establishes an early intervention services working group within the Department of Health to study and recommend ways to assist and support deaf and hard of hearing children, including implementation strategies. Requires report to Legislature. Appropriates moneys.

RELATING TO DENTISTS AND DENTAL HYGIENISTS. Amends the qualifications for dentist community service licenses and dentist temporary licenses by requiring the acceptance of candidates who are graduates of a dental college recognized by the American Dental Association Commission on Dental Accreditation. Amends the qualifications for dental hygienist community service licenses by requiring acceptance of candidates who are graduates of a dental hygiene college recognized by the American Dental Association Commission on Dental Accreditation. Adds community health centers to the list of eligible organizations that may employ a dental provider with a community service license.

RELATING TO ORAL HEALTH. Establishes an oral health task force to review the status of oral health in the State and make recommendations to improve oral health infrastructure in Hawaii. Appropriates funds.

RELATING TO HEALTH. Authorizes psychiatrists and advanced practice registered nurses to file a petition to initiate the administrative authorization process in cases where the patient objects to treatment and is not in the custody of the director or involuntarily committed to a psychiatric facility.

RELATING TO TRAVELING TEAM PHYSICIANS. Adopts model legislation to allow traveling team physicians to temporarily practice medicine in the State for the traveling team members and coaches.
