RELATING TO HEALTH DATA SHARING. Establishes the Hawaii health data exchange framework. Establishes the stakeholder advisory group to assist the department of health in the development of the framework. Requires certain health care organizations to execute a health data sharing agreement by 9/1/2024. Establishes deadlines for certain entities to begin sharing health information. Appropriates funds.

RELATING TO CHAPTER 457J, HAWAII REVISED STATUTES. Makes permanent the existing exemption for birth attendants to continue to practice without a license, under certain conditions. Expands qualifications for licensure to include the North American Registry of Midwives portfolio evaluation process.

RELATING TO THE COMMUNITY COURT OUTREACH PROJECT. Makes the community court outreach project permanent. Amends the project to address homeless defendants and expand the opportunities for eligible defendants to participate. Appropriates funds for additional personnel and enhanced security services.

RELATING TO REHABILITATION. Expands the criminal justice diversion program. Amends the allowable period of court-ordered assisted community treatment and considerations for extensions. Allows courts to require certain probation violators to undergo mental health evaluation and treatment as a condition of continued probation. Requires DOH to contract with behavioral health crisis centers. Appropriates funds.

RELATING TO ASSISTED COMMUNITY TREATMENT ORDERS. Extends the time period that a family court may order continued assisted community treatment. Reduces the time period that a family court needs to determine whether assisted community treatment should continue.

RELATING TO HEALTH. Requires certain patients subject to emergency hospitalization to be assessed to determine whether a surrogate or guardian is needed to make appropriate health care decisions for the patient.

RELATING TO GUARDIANSHIP. Amends the Uniform Probate Code to allow courts to appoint emergency guardians for respondents who reside in psychiatric facilities, hospitals, and homeless shelters. Extends the appointment period. Clarifies that guardians may consent to care, treatment, or service over the objection of wards. Sunsets 1/1/2028.

RELATING TO ASSISTED COMMUNITY TREATMENT. Permits interested parties to request the director of health to file an assisted community treatment petition on behalf of the interested party. Requires final orders for a petition to be filed within thirty days of the date an assisted community treatment petition is filed. Permits the family court to use online hearings for assisted community treatment petitions. Permits the subject of a petition to stipulate to the proposed order and for the court to enter the stipulated order without an evidentiary hearing. Requires the department of health to report to the legislature on the number of requests for petitions submitted to the director of health.

RELATING TO HEALTH. Authorizes long-acting psychotropic medication to be provided to patients who are subject to emergency examination or hospitalization. Expands the administration of treatment over a patient's objection to include persons in director of health custody at any hospital, subject to an emergency examination, subject of an application for involuntary hospitalization, and subject to a court order regarding fitness to proceed for a criminal trial. Requires orders for treatment over objection proceedings to be expedited. Expands who may file a petition for an order to treat over objection under certain circumstances. Sunsets 7/1/2026.
