RELATING TO THE UNIFORM CONTROLLED SUBSTANCES ACT.

Updates the Uniform Controlled Substances Act, chapter 329, Hawaii Revised Statutes, to make it consistent with amendments in the federal controlled substances law as required by section 329-11, Hawaii Revised Statutes.

RELATING TO CONTROLLED SUBSTANCES.

Bans hemp products that contain Delta 8 tetrahydrocannabinol.  Adds Delta 8 tetrahydrocannabinol to the list of schedule I controlled substances.

RELATING TO MEDICAL CANNABIS.

Amends various statutory provisions for the purpose of strengthening the integrity of medical cannabis law.

RELATING TO MEDICAL CANNABIS DISPENSARIES.

Establishes system access and system integration requirements for the computer software tracking system for medical cannabis dispensaries.  Requires the department of health to submit an annual report to the legislature on data captured using the computer software tracking system.

Status

RELATING TO MEDICAL CANNABIS.

Defines "waiting room" within a medical cannabis retail dispensary and allows primary caregivers, qualifying out-of-state patients, and caregivers of a qualifying out-of-state patient to access the waiting room; clarifies that each day of a violation of chapter 329D, is a separate violation; and amends the rule-making authority for dispensary-to-dispensary sales.

RELATING TO MEDICAL CANNABIS.

Amends the dispensary program licensing fee structure.  Adds or clarifies signage, manufactured cannabis product, packaging, escort, and background check requirements for the medical cannabis dispensary program.  Establishes annual reporting requirements to increase public transparency regarding the medical cannabis registry program.  Makes various housekeeping amendments.

Status

RELATING TO CANNABIS FOR MEDICAL USE.

Amends the definition of "cannabis" to include cannabis propagules and cannabis cuttings.  Allows qualifying patients and primary caregivers who are authorized to cultivate cannabis for medical use to purchase cannabis propagules and cannabis cuttings from licensed dispensaries in the State under certain conditions.  Establishes quantity limits and quality requirements for the dispensing of cannabis propagules and cannabis cuttings.  Defines "cannabis cutting" and "cannabis propagule".

RELATING TO HEALTH.

Authorizes naturopathic physicians to provide written certification to qualifying patients for the medical use of cannabis.  Clarifies provisions regarding the establishment of bona fide physician-patient, naturopathic physician-patient, and advanced practice registered nurse-patient relationships via telehealth.

Status

RELATING TO MEDICAL CANNABIS.

Allows health care facilities to permit terminally ill patients to use medical cannabis under certain conditions.

RELATING TO CANNABIS.

Amends the Hawaii Revised Statutes to replace the word "marijuana" and related terms with the term "cannabis" or related terms, as appropriate.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
