      Status & Testimony

RELATING TO MINORS.

Expands the provisions for a minor to consent to no-cost emergency shelter and related services under certain circumstances provided that the provider supplying the shelter is licensed and in compliance with zoning and safety regulations.  Requires the Department of Human Services to make every effort to have a shelter for minors on each island.  Makes permanent the amendments to the definition of "provider" to include organizations that are not child placing organizations or child caring institutions that meet certain criteria.  Requires the Department of Human Services to amend its administrative rules to allow non-licensed child placing organizations with documented experience providing shelter and supportive services to be pre-qualified for a certificate of approval from the Department of Human Services.

RELATING TO LOAN REPAYMENT FOR HEALTH CARE PROFESSIONALS.

Appropriates funds for the Loan Repayment Program for Health Care Professionals, provided that the funds are matched on a dollar-for-dollar basis by funds from a private or another public source.

      Status & Testimony

RELATING TO HUMAN TRAFFICKING.

Establishes a statewide prevention program overseen by the Department of the Attorney General to provide services and assistance to commercially sexually exploited children and to victims of human trafficking.  Requires reports to the Legislature.

RELATING TO EARLY LEARNING ACCREDITATION.

Establish within the Department of Human Services' Child Care Assistance Program, a Child Care Accreditation Program to support licensed or registered child care providers to obtain accreditation from a national early learning accrediting organization.  Extends the deadline by which unaccredited service providers of the Preschool Open Doors Program must commence the accreditation process and obtain accreditation.  Appropriate funds.

RELATING TO CHILD CARE WORKERS.

Requires the Department of Human Services to establish and administer a two-year Infant and Toddler Child Care Worker Subsidy Pilot Program.  Requires annual reports on the pilot program's development and administration to the Legislature.  Appropriates funds.

RELATING TO THE STATE REHABILITATION COUNCIL.

Reduces the number of members on the State Rehabilitation Council from twenty-one to fifteen.  Authorizes the State Rehabilitation Council to establish a quorum and conduct business without regard to vacancies.

RELATING TO CAMPAIGN FINANCE.

Allows candidates seeking election to use campaign funds for child care and vital household dependent care costs under certain conditions.

RELATING TO ACCESSIBILITY.

Requires a retail establishment with an employee toilet facility to allow a customer suffering from an eligible medical condition to use that restroom during normal business hours, under certain conditions.  Exempts a retail establishment and employees from civil liability in allowing an eligible customer to use an employee toilet facility in certain circumstances.  Establishes fines.

RELATING TO DISABILITY HEALTH DISPARITY.

Requires the State Council on Developmental Disabilities to submit a report focused on the health disparities experienced by individuals with developmental or intellectual disabilities in the State to the Legislature prior to the convening of the regular session of 2025.  Appropriates funds.

RELATING TO THE YOUTH COMMISSION.

Clarifies that a majority of the members appointed to the Youth Commission shall constitute a quorum to do business.  Authorizes the Youth Commission to appoint an executive director.

RELATING TO PUBLIC-PRIVATE PARTNERSHIPS FOR THE DELIVERY OF HEALTH CARE SERVICES.

Expands the definition of "private entity" to include business organizations that are authorized to transact business in the State, including nonprofit management entities that have a certificate of need or license to operate one or more community hospitals or hospitals serving a rural population licensed under the laws of any state.  Beginning January 1, 2024, requires the Chief Executive Officer of the Hawaii Health Systems Corporation or the Chief Executive Officer's designee, before entering into any new agreement or modifying or terminating any existing agreement, to provide written comments to the Governor.

RELATING TO HEALTH.

Adds a voluntary non-opioid option to the sample advance health-care directive form.  Establishes that a prescription presented or electronically transmitted to a pharmacy shall be presumed valid and grants pharmacists immunity from civil, criminal, and professional liability for dispensing an opioid in contravention of a patient's non-opioid directive.

Expands the definition of preceptor to allow for improved accessibility for providers to receive income tax credits.

RELATING TO FUNDING FOR THE DEPARTMENT OF THE ATTORNEY GENERAL TOBACCO ENFORCEMENT UNIT.

Increases and stabilizes the amount of funding for the tobacco enforcement special fund within the Department of the Attorney General by: (1) increasing the amount of funds that the tobacco enforcement special fund can carry over at the end of the fiscal year; (2) increasing the cigarette tax stamp fee and by concurrently increasing the percentage of the cigarette tax stamp fee deposited to the tobacco enforcement special fund; and (3) amending the amount of funds to be deposited in the tobacco enforcement special fund from the Hawaii tobacco settlement special fund.  Effective on July 1, 2023.

RELATING TO INFANT AND EARLY CHILDHOOD MENTAL HEALTH.

Establishes the Infant and Early Childhood Mental Health Program within the Department of Health to provide and coordinate mental health services for children from birth to age five, develop and implement flexible strategies for the delivery of services and workforce training, and promote better understanding of the needs of infants and young children, the importance of positive early relationships, and the benefits of trauma-informed care.

SB 1418

RELATING TO NOISE POLLUTION.

Beginning July 1, 2025, prohibits with certain exceptions, the emission of excessive amplified noise during certain hours on public sidewalks near certain locations in areas zoned as mixed-use or residential without obtaining prior written approval from the Director of Health.  Establishes penalties for violations.  Establishes a two-year pilot program to require the Department of Health to implement the excessive amplified noise control regulation in the Waikiki Special District and submit reports to the Legislature.  Requires the Department of Health to adopt rules.  Appropriates funds.

SB 1473

      Status & Testimony

RELATING TO HEALTH.

Requires the Department of Health and Department of Human Services to develop and adopt rules, policies, and plan amendments necessary to ensure that the state Medicaid program covers medically—needed services, including applied behavior analysis services, for individuals aged twenty—one and older with neurodevelopmental disorders, including autism spectrum disorder.  Requires the Department of Health and Department of Human Services to apply for any necessary approvals from the Centers for Medicare and Medicaid Services to amend the state medicaid plan to provide reimbursements for medically—needed services, including applied behavior analysis services, for individuals aged twenty—one and older with neurodevelopmental disorders, including autism spectrum disorder.

RELATING TO MEDICAID.

Appropriates moneys for the achievement of full funding, including estimated payment increases, of Medicaid Home- and Community-Based Services.

RELATING TO CRISIS INTERVENTION.

Establishes a Crisis Intervention and Diversion Program within the Department of Health to divert those with mental health issues to appropriate health care services.  Defines "crisis center" and "crisis intervention officer".  Authorizes a person believed to be imminently dangerous to self or others by a law enforcement officer to be assisted by a crisis intervention officer and transported to a designated crisis center.  Appropriates funds for the Crisis Intervention Team Program and for each county to certify law enforcement officers in mental health first aid, as disseminated by the National Council for Mental Wellbeing, and the crisis intervention team model, as developed by Crisis Intervention Team International.

SB 1615

RELATING TO THE DEPARTMENT OF HEALTH.

Requires the Developmental Disabilities Division of the Department of Health to amend its eligibility criteria for the home and community-based services Medicaid waiver to include individuals having an intellectual or a developmental disability and a comorbid mental illness.
