RELATING TO COMPACTS OF FREE ASSOCIATION.

Establishes the compacts of Free Association Census Task Force within the Department of Human Services to conduct a census of COFA residents in Hawaii.

      Status & Testimony

RELATING TO FETAL ALCOHOL SPECTRUM DISORDERS.

Establishes the Fetal Alcohol Spectrum Disorders Task Force within the Department of Health.  Requires a report to the Legislature.  Dissolves the task force on 7/1/2024.  Appropriates moneys to the Department of Health to establish and support the work of the task force.  Authorizes the Department of Health to contract with a third party to assist the task force.

      Status & Testimony

RELATING TO HEALTH.

Establishes permitting and education requirements for pharmacists performing certain diagnostic tests or tests waived pursuant to the Clinical Laboratory Improvement Amendments of 1988 (CLIA).  Expands the definition of "practice of pharmacy" to include the performance of certain diagnostic or CLIA-waived tests.

RELATING TO PRESCRIPTIVE AUTHORITY FOR CLINICAL PSYCHOLOGISTS.

Authorizes and establishes procedures and criteria for prescriptive authority for clinical psychologists who meet specific education, training, and registration requirements.  Requires the Board of Psychology to accept applications for prescriptive authority privilege beginning 7/1/2023.  Requires the Board of Psychology to report to the Legislature prior to the Regular Session of 2024.

RELATING TO PHARMACISTS.

Mandates reimbursement for services provided by participating registered pharmacists practicing within their scope of practice by private and public health plans in the State beginning January 1, 2024.

RELATING TO HEALTH.

Requires the Office of Primary Care and Rural Health to establish and administer a pilot program to collaboratively address the health and wellness needs of Hawai‘i County's most underserved residents and develop a 2030 One Shared Health Vision Plan.  Requires the Office of Primary Care and Rural Health to submit the plan to the Legislature prior to the convening of the Regular Session of 2024.  Appropriates funds.

RELATING TO AMBULANCES.

Appropriate funds to the Department of Health to purchase one advanced life support ambulance to be based on the island of Molokai, and related equipment, and pay related personnel costs for state-certified emergency medical services personnel.

Appropriates funds for the Department of Human Services to purchase health care services for certain low-income, uninsured immigrants.

RELATING TO ACUPUNCTURE.

Makes comprehensive updates to chapter 436E, Hawaii Revised Statutes, regarding acupuncture practitioners to reflect modernized scopes of practice, titles, and licensing and renewal requirements.  Beginning with the renewal for the licensing biennium commencing 7/1/2025, requires licensees to obtain thirty hours of continuing education per licensing biennium.  Allows the Board of Acupuncture to issue licenses by reciprocity.

      Status & Testimony

RELATING TO HEALTH.

Authorizes long-acting psychotropic medication to be provided to patients who are subject to emergency examination or hospitalization.  Expands the administration of treatment over a patient's objection to include persons in director of health custody at any hospital, subject to an emergency examination, subject of an application for involuntary hospitalization, and subject to a court order regarding fitness to proceed for a criminal trial.  Requires orders for treatment over objection proceedings to be expedited.  Expands who may file a petition for an order to treat over objection under certain circumstances.

RELATING TO HEALTH.

Appropriates funds to the department of health to develop and implement statewide media, education, and training activities for policies related to emergency examination and hospitalization and assisted community treatment for those in need of mental health intervention.

RELATING TO TELEHEALTH.

Clarifies reimbursement for services provided through telehealth via an interactive telecommunications system.  Defines "interactive telecommunications system".  Clarifies that, for services furnished for purposes of diagnosis, evaluation, or treatment of a mental health disorder to a patient in the patient's home, interactive telecommunications may include audio-only communication in certain circumstances.

      Status & Testimony

RELATING TO THE REPEAL OF ACT 212, SESSION LAWS OF HAWAII 2021, AS AMENDED BY ACT 150, SESSION LAWS OF HAWAII 2022.

Repeals the requirement to transfer the Oahu Regional Health care system in its entirety from the Hawaii Health Systems Corporation to the Department of Health.

RELATING TO LICENSES TO SOLEMNIZE MARRIAGES.

Establishes a uniform fee for licenses to solemnize marriages.

RELATING TO FEES FOR MARRIAGE LICENSES.

Increases the marriage license fee from $60 to $100, increases the compensation for a marriage license agent from $9 to $15 per license, authorizes deposits of marriage license fees into the vital statistics improvement special fund, and adjusts the distribution of the marriage license fee among various domestic violence prevention special funds.

RELATING TO UNLICENSED CARE HOMES.

Clarify the group of professionals who are prohibited from knowingly referring or transferring patients to an uncertified or unlicensed care facility, and repeal the landlord exclusion.

RELATING TO INSURANCE.

For policies, contracts, plans, agreements, and plan contracts issued or renewed after 12/31/2023, requires insurers, mutual benefit societies, and health maintenance organizations to provide coverage for standard fertility preservation services.

      Status & Testimony

RELATING TO THE PRACTICE OF BEHAVIOR ANALYSIS.

Makes permanent the exemption from the behavior analyst licensing requirements for teachers working in collaboration with a licensed behavior analyst or licensed psychologist.  Removes the exemption from the behavior analyst licensing requirements for direct support workers and allows a registered behavior technician who is under the direction of a licensed psychologist to implement applied behavior analysis services.

Clarifies the definitions of "caregiver support services", "kupuna care services", and "respite care".

Clarifies the allowable revenues to be deposited into the Executive Office on Aging special fund and the purposes for which the fund may be used.
