      Status & Testimony

RELATING TO MINORS.

Provides that a school counselor, domestic violence victim advocate, or other mental health professional licensed by the State may petition for a protective order on a minor's behalf when the minor's parent or guardian is unwilling or unable to submit a petition.

RELATING TO CUSTODY AND VISITATION.

Adds coercive control and litigation abuse by a parent of a child to the list of factors the court shall consider in determining what constitutes the child's best interest when awarding custody and visitation rights to individuals.  Defines "coercive control" and "litigation abuse".

RELATING TO CHILD CUSTODY.

Requires certain individuals attempting to serve as child custody evaluators to complete a training course on the dynamics of domestic violence every three years.  Requires individuals to submit a letter or certificate of completion to the Family Court.

RELATING TO THE CHILD WELFARE SERVICES.

Establishes under the Hawaii Children's Trust Fund Coalition a collective impact program called the Malama ‘Ohana Program to seek, design, and recommend transformative changes to the State's existing child welfare system.  Requires the Malama ‘Ohana Program to report to the legislature before the Regular Session of 2025.  Appropriates funds.

SB 295

      Status & Testimony

RELATING TO THE CHILD WELFARE SERVICES.

Establishes within the Office of Wellness and Resilience, the Malama Ohana Working Group to seek, design, and recommend transformative changes to the State's existing child welfare system.  Allows the Office of Wellness and Resilience to contract with an administrative facilitator to provide necessary support for the Malama Ohana Working Group in carrying out its duties.  Requires the Malama Ohana Working Group to report to the Legislature prior to the Regular Session of 2025 and be dissolved upon the adjournment thereof.  Appropriates funds.

SB 398

      Status & Testimony

RELATING TO CHILD WELFARE.

Expands the investigative powers of the Department of Human Services to include review and investigation of families that receive benefits from the State's adoption assistance program, against whom a post-adoption complaint has been made.  Requires the Department of Human Services to report to the Legislature prior to the convening of the 2025 Regular Session on the impact of expanding post-permanency services to families receiving benefits from the adoption assistance program.  Establishes a working group within the Department of Human Services to consider, develop, and recommend transformative changes to the State's existing child welfare system, and report to the Legislature prior to the 2025 Regular Session.  Appropriates funds to provide additional support, resources, and monitoring of post-permanency services.  Repeals the Malama Ohana Working Group on 6/30/2025.

SB 406

      Status & Testimony

RELATING TO CHILD VISITATION.

Allows grandparents of a minor child to petition the court for an order granting reasonable visitation rights when the child's parent is unable to exercise parental visitation due to death or incarceration.  Sets forth procedures, considerations, and standards for the court to grant grandparent visitation rights.  Specifies that any person who violates the terms and conditions of a court order granting reasonable grandparent visitation rights may be held in contempt of court.

SB 407

      Status & Testimony

RELATING TO CHILD PROTECTION.

Establishes a definition for "immediate harm" and amends the definition of "imminent harm" for the purpose of the Child Protective Act.  Requires a police officer who assumes protective custody of a child who is subject to immediate harm while in the custody of the child's family to provide a written report detailing the observations justifying the immediate removal to the Department of Human Services within twenty-four hours of assuming custody of the child.
