RELATING TO TIME SHARING PLANS.

Specifies that primary plan documents be listed in the public disclosure statement of a time share plan.  Clarifies the manner in which the required disclosure of liens, title defects, or encumbrances on the titles of units may be made.  Provides that a review of encumbrances shall be waived upon the certification from the developer that the time share interest is free and clear of blanket liens or that identifies all blanket liens.  Effective 6/30/3000.  (HD1)

Status

RELATING TO TIME SHARING.

Requires a developer's application for registration or annexation to include a list of projects containing out-of-state time share units and a statement that the developer has verified that those units are in compliance or not prohibited under the laws of the jurisdiction where the units are located.  Clarifying that a developer is not required to submit any other evidence of such compliance to register in Hawaii.  Effective 6/30/3000.  (HD1)

RELATING TO TIME SHARING PLANS.

For time share plans that use title-holding trusts, requires the developer to submit a title report evidencing that the title is vested in the trustee.  For time share plans that use a notice of time share plan, requires the recordation of the notice and its submission.  For time share plans that use alternative arrangements, requires the recordation of any alternative arrangement documents.  Effective 6/30/3000.  (HD1)

RELATING TO THE RESIDENTIAL LANDLORD-TENANT CODE.

Allows a landlord or landlord's agent to charge an application screening fee for certain applicants at the time a rental application is processed for residential property.  Requires the landlord or landlord's agent to provide a receipt for payment of the application screening fee and a breakdown of the fee.  Requires the landlord or landlord's agent to return any unauthorized fee amounts to the applicant.  Requires, beginning on 5/1/2024, the office of consumer protection to produce and make available informational materials and publicize requirements regarding application fees and related rights and obligations.  Effective 6/30/3000.  (HD1)

RELATING TO THE PRACTICE OF PHARMACY.

Exempts manufacturers, wholesale distributors, and third-party logistics providers of home dialysate drugs or devices from the license, registration, and permit requirements for pharmacies, under certain conditions.  Effective 6/30/3000.  (HD1)

RELATING TO EMERGENCY MEDICAL SERVICES.

Repeals the sunset date of section 2 of Act 119, Session Laws of Hawaii 2021.  Appropriates funds for air ambulance services.  Effective 7/1/3000.  (HD1)

Status

RELATING TO DENTISTRY LICENSES.

Adds community health centers, rural health centers, and mobile dental outreach programs to the list of eligible organizations at which those with a community service license may practice.  Allows dental hygiene and dental college graduates who have graduated from educational programs that have a reciprocal agreement with the American Dental Association Commission on Dental Accreditation to apply for temporary or community service licenses.  Expands eligibility for a community service license to practice dentistry to those candidates who have passed the Integrated National Board Dental Examination within five years of the date of request.  Allows an applicant for a licensure to practice dentistry to submit evidence to the board of dentistry that the applicant passed the Integrated National Board Dental Examination.  Effective 6/30/3000.  (HD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
