SENATE RESOLUTION

REQUESTING THE DEPARTMENT OF LAND AND NATURAL RESOURCES TO TRANSFER TO THE COUNTY OF MAUI THE LAHAINA PUBLIC LIBRARY MAKAI LAWN.

WHEREAS, makai lawn of the Lahaina Public Library is not being used; and

WHEREAS, members of the public have not been able to obtain permits to use the land for events; and

WHEREAS, the land in question is owned by the State; and

WHEREAS, the land could be put to good use if the County of Maui owned the land and leased it to the Lahaina Restoration Foundation; and

WHEREAS, the State should take the initiative to resolve this issue; now, therefore,

BE IT RESOLVED by the Senate of the Thirty-second Legislature of the State of Hawaii, Regular Session of 2023, that the Department of Land and Natural Resources is requested to transfer to the County of Maui the Lahaina Public Library makai lawn; and

BE IT FURTHER RESOLVED that the transfer be made through a quitclaim deed, or other appropriate means; and

BE IT FURTHER RESOLVED that once the property in question is transferred to the County of Maui, the County enter into negotiations to lease the property to the Lahaina Restoration Foundation; and

BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources, Mayor of the County of Maui, Chairperson of the Maui County Council, and President of the Lahaina Restoration Foundation.
