A BILL FOR AN ACT

 

 

RELATING TO SUSTAINABLE LAND USE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that increasing agricultural and renewable energy productivity are state priorities.  However, agriculture and renewable energy sectors are land-use intensive.  Agrivoltaics, or the simultaneous use of areas of land for both solar photovoltaic power generation and agriculture, is a potential solution to accommodate and help meet the State's agriculture and renewable energy goals.

     The purpose of this Act is to require the office of planning and sustainable development to conduct a study to assess the possible implementation of widescale agrivoltaic adaptation and use statewide.

     SECTION 2.  (a)  The office of planning and sustainable development shall conduct a study to assess the implementation of widescale agrivoltaic adaptation and use statewide.

     (b)  The office of planning and sustainable development shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2025.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for the office of planning and sustainable development to conduct a study to assess the possible implementation of widescale agrivoltaic adaptation and use statewide pursuant to this Act.

     The sums appropriated shall be expended by the office of planning and sustainable development for the purposes of this Act.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for the establishment of one full-time equivalent (1.0 FTE) position within the office of planning and sustainable development.

     The sums appropriated shall be expended by the office of planning and sustainable development for the purposes of this Act.

     SECTION 5.  This Act shall take effect on July 1, 2050.
