A BILL FOR AN ACT

 

 

Relating to THE DEPARTMENT OF HUMAN SERVICES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The department of human services shall designate a new category of services composed of adult day care and adult day health care for the purposes of medicaid reimbursement; provided that adult day care and adult day health care shall not be designated within the same category of services as care homes and foster care homes for the purposes of medicaid reimbursement.

     (b)  The department of human services shall establish a medicaid per diem reimbursement rate for a provider of adult day care of not less than the social model average daily rate of $80; provided that the rate shall not be less than the medical model average daily rate of $95 for a provider of adult day health care.  For the purposes of this subsection, a "provider of adult day care" and "provider of adult day health care" means an adult day care facility licensed by the department of health that provides preventive, therapeutic, and rehabilitative services under professional supervision to meet the needs of functionally impaired adult participants for not more than twelve hours per calendar day.

     (c)  The department of human services shall establish standard assessment criteria for medicaid coverage to be used by all managed care organizations contracted with med-QUEST for admitting a candidate to adult day care or adult day health care.

     SECTION 2.  The department of human services shall prescribe rules, in accordance with chapter 91, that prohibit a managed care organization contracting with med-QUEST to provide medicaid benefits from terminating or modifying an existing provider network contract solely on the basis of a provider's change of ownership or ownership structure.

     SECTION 3.  This Act shall take effect upon its approval.
