A BILL FOR AN ACT

 

 

RELATING TO ENVIRONMENTAL IMPACT STATEMENTS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 343, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§343-    Department of agriculture lands; food production; exemption.  The proposed drilling, construction, or use of a well and well appurtenances on lands leased from the department of agriculture shall be exempt from the requirements of this chapter; provided that the land is used to support agriculture and food production."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050.

Description:

Exempts the proposed drilling, construction, or use of a well and well appurtenances on lands leased from the Department of Agriculture from environmental review requirements, provided that the land is being used to support agriculture and food production.  Effective 7/1/2050.  (SD1)
