A BILL FOR AN ACT

relating to water carriers.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 271G, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§271G-   Records of fireworks. (a) All water carriers shall keep a record of any person who retrieves from a terminal facility, fireworks that the water carrier has transported. The records shall contain the name, address, contact information, photocopy of the individual's State-issued identification card or driver's license, a photo of the individual retrieving fireworks from the terminal facility, and a statement signed by the individual declaring whether the fireworks are for personal or business purposes; provided that, if any business purpose is declared, the statement shall contain the business name and contact information.

(b) The water carrier shall maintain the records required by subsection (a) for two years, in the form the public utilities commission requires, and shall make the records available for inspection to any government agency, including an annual compilation of the records required by subsection (a). The annual compilation shall be made available no later than by January 15 of each year.

(c) Any water carrier in violation of this section shall be subject to a fine of not less than $25 nor more than $500. Each violation shall constitute a separate offense. Amounts so collected by the commission shall be paid into the general fund.

(d) For the purposes of this section:

"Fireworks" has the same meaning as in section 132D-2.

"Terminal facility" has the same meaning as in section 382‑1."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
