A BILL FOR AN ACT

 

 

RELATING TO NUMBER PLATES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that a county director of finance may refrain from issuing, or request the return of, a number plate or special number plate for various reasons, including the use of language that is publicly objectionable.  However, the legislature notes that the lack of adequate penalties for failure to comply with a request for the return of a number plate or special number plate may result in an individual's refusal to comply with the request.  The legislature believes that establishing penalties for failure to comply with these requests will improve compliance.

     Accordingly, the purpose of this Act is to establish penalties for failure to return a number plate or special number plate.

     SECTION 2.  Chapter 249, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§249-    Failure to return number plates.  Any person who fails to comply with a request made by a county director of finance for the person to return a number plate issued pursuant to section 249-7 or special number plate issued pursuant to section 249‑9.1 shall be liable for a fine of $          , revocation of the person's driver's license, or both."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on March 22, 2075.
